_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />Staff Recommendation <br />Based on the available information and evidence and preceding findings of compliance with the <br />Tentative PUD approval criteria at EC 9.8325 and Tentative Subdivision at EC 9.8520, staff <br />recommends the Hearings Official conditionally approve the request with the conditions listed <br />below: <br /> <br />1. On the final PUD site plans and final plat, the applicant shall create an access restriction <br />strip along the westerly boundary line of Lot 15 abutting Hawkins Lane. <br /> <br />2. Prior to final plat approval, the applicant shall demonstrate approval from the regional <br />road naming group for alternate street names to replace “Stonehedge Way” and <br />“Stonehedge Court”. <br /> <br />3. The private streets shall be labeled on the final plat and final PUD site plans as <br />“[Approved Street Name] - Private”. <br /> <br />4. The structural design and construction inspection for the private streets will remain the <br />developer’s responsibility. Certification by a licensed engineer that a structural design <br />meeting the applicable standards will be required at the time of the site development <br />permit for the private street. <br /> <br />5. Prior to final PUD and plat approval, the applicant shall submit Private Joint Use Access <br />and Utility Easement and Maintenance Agreement (JAM). The JAM will include a <br />description defining the area of the private street and will also identify permitted <br />improvements, construction expectations, rights of usage and maintenance <br />responsibilities for the facilities in the street. The JAM will be recorded concurrent with <br />and cross-referenced on the final plat. <br /> <br />6. Provisions for a public emergency access easement within the private street may be <br />included in the proposed JAM which creates the private street, or alternatively may be <br />dedicated as a Public Emergency Access Easement on a standard City form. <br /> <br />7. Prior to final plat approval, the applicant shall dedicate a 14-foot Public Utility Easement <br />or Public Wastewater Easement that will encumber the proposed public wastewater <br />system. The required easement shall also be shown on revised final PUD plans. <br /> <br />8. The final PUD site plans shall include the following note: “No building, structure, tree or <br />other obstruction shall be placed or located on or in a Public Utility Easement, consistent <br />with EC 9.6500(3)”. <br /> <br />9.
