_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />conceptually complies with applicable sewage specifications, subject to a more detailed review <br />during the subsequent PEPI permit process and building permit process. <br /> <br />EC 9.6505(3) and (4) Streets, Alleys, and Sidewalks: This section requires all streets in and adjacent <br />to the development site to be paved to the width specified in EC 9.6870 and improved according to <br />adopted standards and specifications pursuant to EC Chapter 7, unless such streets have already <br />been paved to that width. The improvements are to include drainage, curbs & gutters, sidewalks, <br />street trees and street lights adjacent to the development site according to the City’s adopted <br />“Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways and Accessways”. <br /> <br />As discussed earlier at EC 9.6870 Street Width, Hawkins Lane has been constructed to City <br />standards with the exception of sidewalks abutting the proposed development, and Randy Lane <br />has been constructed to City standards with the exception of setback sidewalks and street trees. <br />For compliance with this standard, the following conditions are warranted: <br /> <br />13. The applicant shall submit an Irrevocable Petition for public improvements in Hawkins <br />Lane to include sidewalks. <br /> <br />14. The applicant shall submit an Irrevocable Petition for public improvements in Randy <br />Lane to include setback sidewalks and street trees. <br /> <br />As an informational item, with respect to the missing sidewalks along Randy Lane and Hawkins <br />Lane, staff notes that the owner, builder, or contractor to whom any future building permit is <br />issued to will also be required to obtain a sidewalk construction permit per EC 7.385. <br /> <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street construction costs in the future. The <br />City could construct the street when the majority of benefitting property owners agree to pay for <br />the improvements. <br /> <br />EC 9.6505(5) Bicycle Paths and Accessways: No bicycle paths or access ways are proposed by <br />the applicant, and referral comments from Public Works staff further confirm that neither <br />facility is required. <br /> <br />(c) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard <br />Areas – Standards. <br /> <br />This standard does not apply as the site is not located within a Special Flood Hazard Area per <br />Flood Insurance Rate Maps. <br /> <br />(d) EC 9.6710(6) Geological and Geotechnical Analysis. <br /> <br />In accordance with EC 9.6710(6), unless exempt under EC 9.6710(3), certification is required <br />from and Oregon licensed Engineering Geologist, Geotechnical Engineer, or a licensed Civil <br />Engineer with geological experience to include certain types of information addressing landslide <br />Page 19 of 87
