_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />public utility easement, the City of Eugene could be considered to be trespassing on private <br />property when accessing the public facility for inspection, maintenance or repair of the <br />wastewater line. The 14-foot width is the minimum necessary to allow for public maintenance <br />vehicles to access the entirety of the proposed public wastewater line for inspection and <br />maintenance purposes. The 14-foot width also allows sufficient width for excavation equipment <br />in the event that the line needs to be replaced altogether. Dedication of the PUE/public <br />wastewater easement is roughly proportional to the impact that the proposed development <br />will have on the City’s sewer facilities to serve the development on the new lots which will be <br />using the portion of the system requiring a public easement (roughly 25 of the proposed lots). <br />This is also the last opportunity that the City will have to require the dedication of the necessary <br />PUE. <br /> <br />The applicant is also proposing to dedicate 7-foot PUEs along the existing right-of-way of Randy <br />Lane and Hawkins Lane, as well as to create numerous private access and utility easements <br />throughout the site. The applicant’s proposal is conceptually acceptable, but to ensure <br />compliance, the following condition is warranted: <br /> <br />8. The final PUD site plans shall include the following note: “No building, structure, tree or <br />other obstruction shall be placed or located on or in a Public Utility Easement, <br />consistent with EC 9.6500(3)”. <br /> <br />Based on the above findings and conditions, this standard is met. <br /> <br />EC 9.6505 Improvements – Standards <br />These standards require that all public improvements be designed and constructed in <br />accordance with adopted plans, policies, procedures and standards specified in EC Chapters 6 <br />and 7. The public improvement standards in EC Chapter 7 also require the developer to enter <br />into an agreement establishing installation and maintenance responsibilities for street trees in <br />accordance with the standards in EC 7.280. Additionally, all developments are required to be <br />served by and implement infrastructure improvements including water, sewage, streets, street <br />trees, street lights, sidewalks, access ways, and stormwater drainage. To ensure compliance as <br />part of the subsequent permitting processes for development of the proposed Tentative PUD <br />and Subdivision, the following conditions of approval are recommended: <br /> <br />9. The final PUD site plans shall include the following note: “Compliance with public <br />improvement requirements shall be demonstrated in accordance with EC 9.6505 as part <br />of the permitting process for development within the PUD including Privately <br />Engineered Public Improvement (PEPI) Permits, Site Development Permits and Building <br />Permits.” <br /> <br />10. The final PUD site plans shall include the following note: “A Privately Engineered Public <br />Improvement (PEPI) permit shall be issued for the construction of public improvements <br />prior to development.” <br /> <br />Page 17 of 87
