professional wetland consultant confirms that there is no wetland within the area <br />proposed for development, and the mapped site BD 21 is not wetland. These mapped <br />features are not recommended for preservation or protection under the Eugene plans. <br />The applicant plans to follow State and Federal permitting requirements, as necessary <br />(and if necessary), as associated with the mapped site (BD 21). <br />EC 9.8520(6): On R-1 zoned property, if the subdivision results in a lot greater than 13,500 <br />square feet in size based on EC 9.2761(5)(b), the application shall indicate the location of lot <br />lines and other details of layout that show future division may be made without violating the <br />requirements of this land use code and without interfering with the orderly extension of <br />adjacent streets, bicycle paths, and accessways. Any restriction of buildings within future <br />street, bicycle path, and accessway locations shall be made a matter of record in the tentative <br />plan approval. <br />The remainder of the parent parcel is 9.2 acres, and in excess of excess of 13,500 square <br />feet; a conceptual layout for it is shown. A detailed potential layout for SE portion of <br />the remainder is shown and noted as lots 20-29. (note: we have shown the remainder as <br />a separate Lot. If this is not necessary, to meet City policy, we will simply leave it as the <br />remainder of Lot 1.) <br />EC 9.8520(7): The subdivision complies with development standards explicitly addressed in <br />the application or is granted adjustments thereto pursuant to the provisions beginning at EC <br />9.8015 of this land use code. <br />The proposed subdivision complies with all development standards explicitly addressed <br />in the application and no adjustment have been requested. This criterion is satisfied. <br />EC 9.8520(8): Where all or a portion of a development site is within the South Hills Study and <br />above 700 feet in elevation, the proposed development shall have received initial approval <br />through the Planned Unit Development process. Where all or a portion of the development <br />site is within the South Hills Study and is between 500 and 701 feet, and the development site <br />is at least 4 acres in areas of the development site containing slopes that exceed 20%, the <br />proposal shall have received initial approval through the Planned Unit Development process. <br />The subject site is not located within the South Hills Study.
