Response: No housing is proposed with this tentative subdivision plan. The applicant elects to use the general/ discretionary <br />approval criteria in EC 9.8515. <br />(6) The written statement submitted with the subdivision application shall clearly state whether the applicant is electing <br />to use the expedited land division procedures in EC 9.7900 through EC 9.7925 and how the applicant believes that the <br />proposal qualifies for the expedited land division procedures in EC 9.7900 through EC 9.7925. <br />Response: The applicant is electing not to use the expedited land division procedure. This written statement addresses the general <br />and /or discretionary approval criteria contained in EC 9.8515, addressed herein. <br />EC 9.8515 — Subdivision, Tentative Plan Approval Criteria — General/ Discretionary. <br />The planning director shall approve, approve with conditions, or deny a proposed subdivision. Approval, or approval with <br />conditions shall be based on compliance with the following criteria: <br />(1) The proposed subdivision complies with all of the following, unless specifically exempt from compliance through a <br />code provision applicable to a special area zone or overlay zone: <br />(a) EC 9.2000 through 9.4170 regarding lot dimensions and density requirements for the subject zone and overlay <br />zone. Within the /WR Water Resources Conservation Overlay Zone, no new lot may be created if more than 33% of <br />the lot, as created, would occupy either. <br />1. The combined area of the /WR conservation setback and any portion of the Goal 5 Water Resource <br />Site that extends landward beyond the conservation setback, or <br />2. The /WQ Management Area. <br />Response: The subject property is not located in a /WR or /WQ overlay zone area. EC 9.8515(1)(a) and/or (b) are not applicable to <br />this proposal. The subject property is approximately .93-acre making the maximum density for this specific property 14 primary <br />dwelling units. The proposed subdivision intends to create five new parcels. No housing is proposed at this time; any future <br />development will not exceed fourteen primary dwelling units. The proposal complies with density requirements. <br />As no development is proposed with this tentative subdivision application, the remaining zone development standards do not apply. <br />The proposal complies with all applicable criteria contained in EC 9.2750. <br />EC 9.2760 — Residential Zone Lot Standards/ <br />EC 9.2775 — Residential Flag Lot Standards for R-1, R-2, R-3, and R-4. <br />Response: This tentative subdivision plan proposes the creation of five (5) new parcels on the subject property. Lot 1 is proposed <br />as a standard, interior lot; Lots 2-5 are proposed as flag lots. Eugene Code criteria for both types of lots proposed are summarily <br />addressed herein as applicable. <br />
