(10) The applicant is required to hold one meeting prior to submitting an application for a specific site but may hold <br />additional meetings if desired. <br />Response: No additional meetings were requested by neighbors at the September 6th neighborhood meeting. No additional <br />meetings are planned at this time. <br />(11) If an applicant fails to include in its application the materials described in EC 9.7010, the application shall be deemed <br />incomplete. <br />Response: All items delineated in EC 9.7010 have been submitted with this Tentative Subdivision application. <br />(12) Applications shall be submitted to the city within 180 days of the neighborhood/applicant meeting. If an application is <br />not submitted in this time frame, or if the site plan submitted with the application does not substantially conform to the <br />site plan provided at the meeting, the applicant shall be required to hold a new neighborhood/applicant meeting. <br />Response: A neighborhood meeting was held on September 6, 2023, making the final day for application submittal March 4, 2024. <br />The application is submitted within the 180-day period and the site plan submitted is the same as the site plan provided at the <br />meeting. <br />EC 9.8510 — Subdivision, Tentative Plan Application Requirements. <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific requirements shall apply to tentative <br />subdivision plan applications: <br />(1) All tentative subdivision applications shall be prepared by an Oregon licensed land surveyor and shall include a <br />preliminary title report. <br />Response: The tentative subdivision plan was prepared by Ryan Erickson, PLS of EGR & Associates. A preliminary title report is <br />included with the application submittal materials. See attached Fidelity National — Surveyor's Title Report for the subject property. <br />(2) The application shall include all contiguous undeveloped or partially developed property under the same ownership <br />as the subject property, be signed by the owner of the property, and include such related information as prescribed by the <br />planning director. <br />Response: There are no contiguous properties under the same ownership as the subject property. <br />(3) The tentative subdivision plan application shall include a phasing plan that indicates any proposed phases for <br />development, including the boundaries and sequencing of each phase. Phasing shall progress in a sequence that <br />promotes street connectivity between the various phases of the development and accommodates other required public <br />improvements. <br />Response: No phasing plan is proposed for the proposed five -lot tentative subdivision. <br />(4) The lot proposed to be divided in the subdivision application is a legal lot. <br />Response: The subject property is a legal lot of record per EC 9.0500(B) as it was originally created in 1912 as Lot 1 of The Oaks <br />Subdivision Plat, as platted and recorded in Book 4, Page 106 of the Lane County Oregon Plat Records and subsequently created <br />in its current configuration in 1960 when Assessor's Map & Tax Lot 17-04-15-11-07600 was conveyed out of the property through <br />deeds R159-10825 and R160-12122. See attached - Legal Lot Research & Background. <br />(5) If the proposal includes housing, the written statement submitted with the subdivision application shall clearly state <br />whether the applicant is electing to use the discretionary approval criteria in EC 9.8515 Subdivision, Tentative Plan <br />Approval Criteria — General/Discretionary instead of the approval criteria found in EC 9.8520 Subdivision, Tentative Plan <br />Approval Criteria — Housing/Clear and Objective. <br />
