WRITTEN STATEMENT FOR EASEMENT VACATION SSW Job No. 23-8098 PAGE 4 of 5 <br />(7) For vacations of unimproved public easements and improved public easements, the <br />application must include the signatures of all property owners and owners of <br />property adjacent to the easement being vacated. <br /> <br />This request is for the proposed vacation of a portion of improved public easement. A Consent <br />Form bearing the signature of the owner of the properties subject to the portion of easement <br />proposed to be vacated (also the applicant) is therefore included with this application. Also <br />included are Consent Forms bearing signatures of the owners of properties abutting the subject <br />easement, more specifically adjacent Tax Lot 801 of Map 17-04-17-34 to the west, located at <br />2095 Ohio Street, and adjacent Tax Lot 6800 of Map 17-04-17-43 to the east, located at 5560 <br />Burnett Avenue. This application requirement has therefore been met. <br /> <br />EC 9.8720 Approval Criteria for Vacation of Improved Easements, Unimproved Public <br />Right-of-Way, and Vacation and Rededication of Unimproved Public Right-of-Way. <br />The planning director shall approve, approve with conditions, or deny the vacation <br />application. The application shall be approved if the vacation is found to be consistent <br />with all of the following criteria: <br /> <br />(1) The subject area is not presently or in the future needed for public services, facilities, <br />or utilities, and the vacation does not prevent the extension of, or the retention of <br />public services, facilities, or utilities; or if needed, the applicant shall provide for the <br />replacement and abandonment of any existing public services, facilities, or utilities in <br />the subject area. <br /> <br />The subject PUE was dedicated as part of Land Partition Plat No. 2022-P3062 for purposes of <br />containing existing underground CenturyLink communications and NW Natural gas lines <br />providing service to adjacent Tax Lot 801 located at 2095 Ohio Street (Parcel 1 of the above- <br />referenced land partition). <br /> <br />The natural gas service line was determined to be inactive and has since been disconnected at <br />the main and abandoned in place by NW Natural. Per NW Natural, any future gas service line <br />to 2095 Ohio Street will be constructed by NW Natural in a different location, extending directly <br />from within the Burnett Avenue public right-of-way to the 2095 Ohio Street property without the <br />need for any easements. <br /> <br />Per coordination with CenturyLink, it has been determined that the existing underground <br />communications line is currently inactive and shall be abandoned in place. At the time of any <br />future request for service by the owners or occupants of 2095 Ohio Street, CenturyLink will <br />install a new service line within the northerly 7 foot wide portion of the subject easement <br />proposed to remain and the proposed new portion of 7 foot wide PUE as shown on the site plan <br />included with this application. <br /> <br />No other existing public utilities are located within the easement area, and no other utility <br />companies which provide service in the area indicated via their concurrence responses that the <br />portion of easement proposed to be vacated is needed for any existing or future utilities. <br /> <br />The above findings demonstrate that the portion of easement proposed to be vacated is not <br />presently or in the future needed for public services, facilities, or utilities, the vacation does not <br />prevent the extension of, or the retention of public services, facilities, or utilities, nor is the <br />relocation or replacement of any existing public services, facilities, or utilities necessary at this <br />time. The proposed vacation therefore complies with this criterion.
