<br />Findings & Decision: Rohan Real Estate Investments (PT 21-18) December 2021 8 <br /> <br /> <br />EC 9.6792 Stormwater Quality - In order to reduce runoff pollution and mitigate the volume, <br />duration, time of concentration and rate of stormwater runoff from the development, the <br />applicant must select, size, and locate infiltration or filtration type stormwater quality facilities <br />from the Stormwater Management Manual to treat the stormwater runoff from the shared <br />driveway. <br /> <br />The Stormwater Quality standards at EC 9.6792(3) apply to all land use applications submitted <br />after March 1, 2014. Because the proposed partition does not include the construction of public <br />streets, private streets or new shared driveways, it is specifically subject to the Stormwater <br />Quality Standard at EC 9.6792(3)(a), which requires that the applicant submit a site plan that <br />delineates the areas on the site that have infiltration rates less than 2 inches per hour, bedrock <br />less than 5 feet below ground surface, groundwater elevations less than 6 feet or ground <br />surface slopes greater than 10%. The “Soil Data” notes in the application provide the <br />information required by this standard. <br /> <br />The standards of EC 9.6793 through EC 9.6796 do not apply because the proposed <br />development is at an elevation less than 500 feet, it does not drain directly into a headwaters <br />stream, it does not generate high concentrations of oil and grease and does not include any <br />specific pollutants of concern identified in EC 9.6795(2). <br /> <br />EC 9.6797 Stormwater – Operation and Maintenance – These standards apply to all facilities <br />designed and constructed in accordance with the stormwater development standards. This <br />section also specifies when and under what conditions the public will accept functional <br />maintenance. The applicant proposes private operation and maintenance of the on-site <br />stormwater management facilities. For the applicant’s information, an operation and <br />maintenance plan consistent with the City’s Stormwater Management Manual requirements <br />shall be reviewed and notice of this plan will be recorded during the building permit process. <br /> <br />Based on the above findings and future permit requirements, the stormwater development <br />standards are met. <br /> <br />(k) All other applicable development standards for features explicitly included <br />in the application. <br /> <br />The existing buildings on Parcel 1 will comply with applicable development standards as shown <br />on the applicant’s tentative partition plan. The subject property is within the /CAS Commercial <br />Airport Safety Overlay Zone and is subject to the provisions of EC 9.4130. Its current building <br />heights for remaining structures and other characteristics comply with the standards of this <br />Code section. Any new development on the subject property will be required to meet the <br />requirements of EC 9.4130. <br /> <br />It is noted that future development on the proposed parcels will be subject to further review <br />for compliance with applicable standards, including but not limited to residential development <br />standards in EC 9.2750. <br />
