<br />Findings & Decision: Rohan Real Estate Investments (PT 21-18) December 2021 6 <br /> <br />the existing wastewater mainline within Ohio Street. <br /> <br />Based on the above findings and future permit requirements, the proposed partition complies <br />with applicable wastewater standards. <br /> <br />EC 9.6505(3) Streets and Alleys & (4) Sidewalks - EC 9.6505(3)(a) does not apply because there <br />are no streets within the development. Unless adjacent streets and alleys are already improved <br />to City standards, EC 9.6505(3)(b) requires the developer to pave streets and alleys adjacent to <br />the development site to the width specified in EC 9.6870 Street Width, and to construct related <br />street improvements: drainage, curb and gutter, sidewalks, street trees, and street lights. <br /> <br />As discussed at EC 9.6870 Street Width Burnett Avenue has been constructed to City standards <br />but lacks street trees. For compliance with this standard the following condition is warranted: <br /> <br />• Prior to final plat approval, the applicant shall submit an Irrevocable Petition for <br />public improvements in Burnett Avenue to include street trees. <br /> <br />As previously noted at EC 9.6870 Street Width the segment of Ohio Street abutting the subject <br />property has been improved to City standards, therefore there are no requirements for <br />additional public improvements in this location. <br /> <br />Irrevocable petitions enable the City to initiate a local improvement process and obligate the <br />property owners to pay their proportional share of the street improvement construction costs <br />in the future. The City could construct the street improvements when the majority of <br />benefitting property owners agrees to pay for them. <br /> <br />Based on the above findings and condition, the proposed development will comply with these <br />standards. <br /> <br />EC 9.6505(5) Bicycle Paths and Accessways. No additional bicycle paths or public accessways <br />are propose or required in this instance. <br /> <br />(d) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood <br />Hazard Areas – Standards. <br /> <br />These standards do not apply because the subject property is not located within a special flood <br />hazard area as mapped by the Federal Emergency Management Agency (FEMA) on Flood <br />Insurance Rate Map (FIRM) No. 41039C-1104-F, dated June 2, 1999. <br /> <br />(e) EC 9.6710 Geological and Geotechnical Analysis. <br /> <br />The standards for geotechnical analysis do not apply since the proposed development is not a <br />tentative PUD, subdivision, or site review application, and does not include dedication or <br />proposed construction of a new public street or alley, drainage or wastewater facilities. <br /> <br />
