I to review an application <br />for a conditional - use an d. con s ider p ertin ent evidence and testimony as to whether the conditional <br />use is consistent with the criteria for approval, shown below in bold typeface. <br />EC 9.8090(1): The proposal is consistent with applicable provisions of the Metro Plan and <br />applicable refinement plans. <br />Findin related to the Metro Plan,: <br />Tax Lots 600, 700, and 2900 generally coincide within a commercially-designated strip of <br />land extending west of Riv er Road, and Tax Lots 300 and 400 generally fall within._ a. large low - <br />density residential designated area to the north and west o f this commercial strip. H owever, the <br />lack of physical referents 4n. the vi cin i ty of the sub ect s 1 te, an d the s ca le of th e diagr am m ake i t <br />difficult to precisely locate where the boundary o ccurs between the comm erci a ' I and res identi al <br />area i n relationship to the subject t ax. lots. Moreover, the M etroPlan d iagr am is not tax lot <br />specificfpectic in this case bec aus. e the tax lots under consideration border more than one designation <br />acrd the tai lots are not otherwise shown on a parcel - specific refinement plan (Metro Plan page <br />II-G-2). Recent City file Z 07-14 made similar findings. <br />The Metro Plan acknowledges that a portion of land designated as Low Density Residential will <br />be developed with auxiliar uses (Metro Plan, Page 11-G-3). The church use is specificall <br />identified in the M etro Plan as an aux i I i ary use <br />As well, EC 9.2740 acknowledges church use as an auxiliary use in the R -1 zone. by al- lowing the <br />use subject to a CUP. The CUP process serves as a local contro I intended to address the <br />compatibility o f th e church within th e surrounding residential area. <br />Conclusion related to the Metro Plan: <br />The Metro Plan land use diagram designates Tax Lots 300 and 400 for Low Density Residential <br />use, and Tax Lots 600, 700, and 2900 for Commercial use. The application is consistent with the <br />Metro Plan's land use diagram. <br />Findings and conclusions related to the app licab le refinem en t p lan: <br />The. River Road-Santa C Tara. Urban Facilities Plan (PIRSC) is the refinement plan for the area of <br />this request.
