If additional mitigation measures cannot bring the facility into <br />compliance, the City may issue civil penalties, require further corrective action to mitigate <br />the noise, or potentially revoke the CUP if the violation is not remedied. <br />8. Upon construction and commencement of the telecommunications use, the applicant shall <br />test and provide a report documenting compliance with non-ionizing electromagnetic <br />radiation (NIER) emissions standards as set forth by the Federal Communications <br />Commission (FCC). The applicant shall also provide maps showing the actual coverage <br />provided by the facility for each of the frequencies transmitted. <br />9. The applicant's site plans shall be revised to include the following note "No signs, striping, <br />graphics or other attention getting devices are permitted on the transmission tower or <br />ancillary facilities except for warning and safety signage with a surface area of no more <br />than 3 square feet. Such signage shall be affixed to a fence or ancillary facility and the <br />number of signs is limited to no more than 2." <br />10. The following note shall be added to the final site plan "All transmission towers, antennas, <br />the tower substructure and all above ground ancillary facilities shall be removed by the <br />person who constructed the facility, by the person who operates the facility, or by the <br />property owner, within 6 months of the time that the facilities have ceased being used to <br />transmit, receive or relay voice and data signals to or from wireless communication <br />devices.
