the public hearing, the record was left open for two weeks for the submission of new evidence, <br />one additional week for responses to the new evidence, and one more additional week for the <br />applicant's final legal argument. <br />DOCUMENTS CONSIDERED BY THE HEARINGS OFFICIAL <br />I have considered all of the documents in the planning file for the proposed conditional use <br />permit (CU 14-4), including all the materials submitted during the open record period, as well as the <br />testimony provided at the public hearing. <br />FACTS <br />Verizon Wireless requests approval of a conditional use application (CUP) to install a 75- <br />foot telecommunications tower (cell tower) designed to look like a fir tree (mon-pine), along with <br />a variance to allow the associated ancillary equipment to be located above ground. The subject <br />property is approximately 3.4 acres and is owned by the Neighborhood Assembly of God church <br />church). The property is zoned R-1/UL - Low-Density Residential with an Urbanizable Land <br />Overlay. The property is outside of City limits but inside the urban growth boundary and is <br />therefore subject to the Eugene Code (EC) Chapter 9 as adopted by Lane County.' <br />The property is located at 815 Irving Road in the Santa Clara area on the north side of the <br />street. The church is along Irving Street at the corner of Stark Street. The church is close to Irving <br />Street with parking lots surrounding the church on the north, east, and west sides of the property. <br />The mono-pine is proposed to be constructed in the northern back end of the property away from <br />Irving Street near an existing outbuilding. Neighbors to the east, north, and west have back yards <br />that abut the area proposed for the mono-pine. Aside from one large tree along Irving Street, the <br />property does not have any large trees or significant landscaping. The surrounding area is <br />residential and has some scattered large trees, but no stands or groves of large trees. The mono- <br />pine is proposed to be set back 85 feet from the east property line, 85 feet from the north property <br />line, 200 feet from the west property line, and 335 feet from the south property line. <br />The applicant originally proposed an exception to allow ancillary equipment, including <br />emergency generators, to be located above ground instead of underground or indoors. After a <br />number of noise studies and back and forth between the applicant, staff, and the City's outside <br />consultants, the applicant eventually modified its proposal to eliminate the emergency generators <br />and only seeks a variance to allow air conditioners to be above ground. <br />All EC citations are to the version adopted by Lane County. <br />Hearings Official Decision (CU 14-4) 2 <br />247
