DECISION OF THE HEARINGS OFFICIAL <br />FOR THE CITY OF EUGENE, OREGON <br />CONDITIONAL USE PERMIT REQUEST <br />Application File Name (Number): <br />Verizon Wireless at Neighborhood Assembly of God (CU 14-4). <br />Application Summary: <br />Conditional use permit application to establish a 75-foot mono-pole pine tree cell tower with an <br />associated variance to allow above-ground ancillary facilities. <br />Property Owner/ Applicant: <br />Property Owner: Neighborhood Assembly of God Church <br />Applicant: Verizon Wireless <br />Lead City Staff: <br />Nicholas Gioello, Associate Planner. <br />Subject Property/Zoning/Location: <br />Tax Lots 2600, 2800, 3100, 3200, and 3300 of Assessor's Map 17-04-11-32, located at 815 Irving <br />Road. The subject property is 3.4 acres and is zoned R-1/UL - Low-Density Residential with an <br />Urbanizable Land Overlay. <br />Relevant Dates: <br />The application was submitted on October 3, 2014. The application was deemed complete on <br />March 19, 2015. Applicant requested a time extension of 109 days to provide additional materials <br />in response to staff comments. A public hearing was originally scheduled for August 19, 2015, but <br />the hearing was postponed until October 14, 2015 for the applicant to submit additional evidence. <br />A public hearing was held on October 14, 2015. <br />Summary of the Public Hearing <br />At the public hearing, associate planner Nicholas Gioello (Gioello) discussed the staff report and <br />explained that the applicant had recently submitted additional testimony that the City had not had <br />sufficient time to fully review. Gioello recommended denial of the application. The applicant's <br />representative explained the nature of the application and argued in favor of its approval.
