Oak Way. The property is shaped like an arch or upside down "U." There is a three story existing <br />assisted living facility to the south that the arch arches over. Areas to the south.. west, and northeast <br />are also zoned R-2. Areas to the north and east are zoned R-,1 - Low Density Residential and have <br />existing single family homes. Areas to the southwest are zoned C-2 - Community Commercial <br />and have cominercial uses. The property takes access from Lone Oak Way which rums along the <br />western boundary of the property. The applicant seeks approval of a Planned Unit Development <br />PUD) to construct a 58-bed specialty care facility comprised of five buildings. Two of the <br />proposed buildings are two story, while the other three are one story. The two story buildings <br />would be located along the northern portion of the property closer to exiting residential dwellings. <br />DOCUMENTS CONSIDERED BY THE HEARINGS OFFICIAL <br />I have considered all of the documents in the planning file for the proposed tentative planned <br />unit development, (PDT 16-1) as well as the testimony and documents provided at the public hearing. <br />AN <br />The staff report does a very thorough of job explaining why all the numerous approval criteria <br />are satisfied. Most of the findings in the staff report are not challenged, and it would be a waste of the <br />City's money and resources to review and repeat all of the unchallenged findings. Therefore, I adopt <br />and incorporate the findings in the staff report in this decision, in addition to the following. <br />Eugene Code (EC) 9.8320 provides the approval criteria for PUDs. EC 9.8320(3) provides: <br />The PUD will provide adequate screening from surrounding properties including, but not <br />limited to, anticipated building locations, bulk, and height." <br />Opponents argue that proposed facility will not provide adequate screening, in particular <br />to the single family residences to the north. The application proposes to cut down a number of <br />mature trees that presently provide screening and privacy for those residences. According to <br />opponents, with the trees removed and two story buildings near the property line the new buildings <br />will look straight down into their backyards. The application proposes to construct five buildings <br />and erect a seven-foot fence along the property's northern and eastern property lines. Three of the <br />proposed buildings are one story, and I do not see that any of the one story buildings would have <br />any additional screening need other than the fence. As the applicant's elevations show, the only <br />portion of the one story buildings that would be visible would be the roofs, and no visible windows <br />Hearings Official Decision (PDT 16-1) Page 2222
