testimony, and legal argument; seven additional days for responses to the new evidence, <br />testimony, and legal argument; and seven additional days for the applicant's legal argument.' <br />FACTS <br />The subject property is the site of North Eugene High School, Corridor Elementary School, <br />Yujin Gakuen Japanese Immersion School, and Swede Johnson Stadium. The property is <br />approximately 35.8 acres and is zoned PL. The property is surrounded by single family residential <br />to the north, south, and west - with a mixture of multi-family residential and commercial uses to <br />the east. The Planning Commission applied a SR overlay to the property when it was annexed in <br />1992. The applicant now seeks to remove the SR overlay. <br />DOCUMENTS CONSIDERED BY THE HEARINGS OFFICIAL <br />I have considered all of the documents in the planning file for the proposed zone change (Z <br />20-2) and the testimony provided at the public hearing and during the open record period. <br />ANALYSIS <br />Procedural Issues <br />Due to the corona virus, the public hearing was conducted on-line with the ability of members <br />of the public to participate either by listening in or providing testimony. The notice for the public <br />hearing explained that the public hearing would be conducted on-line and that members of the public <br />could participate either by computer or by phone. The City also decided to preemptively leave the <br />record open in case some people were not able to participate in the on-line hearing. The City also <br />provided a link to a video recording of the public hearing available on the City's website the day after <br />the public hearing. <br />Opponent Kim Young (Young) argues that the City's procedures were inadequate. Initially, <br />Young objects to the alleged short time between the release of the staff report and the public hearing. <br />EC 9.7320 requires that the staff report be made available at least seven days before the public <br />hearing. In this case, the staff report was posted on the City's website on March 25, 2020 - seven <br />days before the public hearing. The City complied with all applicable requirements regarding the staff <br />report. <br />Young also argues that the on-line process was inadequate. Gepper provided a memorandum <br />dated April 14, 2020 that explains the process the City employed and the reasoning behind the <br />1 The public hearing was conducted on-line due to restrictions on public gatherings due to the corona virus.
