19 <br /> <br />maintenance or updating of the comprehensive plan, any related monitoring efforts, or the Eugene <br />urban growth boundary. Therefore, these amendments are consistent with the Envision Eugene <br />Comprehensive Plan. <br /> <br />Refinement Plan Amendment Criteria <br />City of Eugene Criteria <br />EC 9.8424 Refinement Plan Amendment Approval Criteria. <br />Approval, or approval with modifications shall be based on compliance with the following criteria: <br />(1) The refinement plan amendment is consistent with all of the following: <br />(a) Statewide planning goals. <br />(b) Applicable provisions of the Metro Plan. <br />(c) Remaining portions of the refinement plan. <br />EC 9.8422 states, “Refinement plan amendment procedures only apply when specific changes are <br />proposed to an existing refinement plan that covers areas only within the jurisdiction of the city. The <br />procedures are not applicable to comprehensive updates of an entire refinement plan.” <br />The refinement plan criteria in EC 9.8424 do not apply to the Metro Plan amendments because the <br />amendments repeal and replace an existing refinement plan, rather than only applying to specific <br />changes to an existing refinement plan. Additionally, the Urban Facilities Plan that is to be repealed and <br />the new River Road-Santa Clara Neighborhood Plan that is to be adopted cover areas within both the <br />City of Eugene and Lane County jurisdictions. <br />However, even if the Refinement Plan Amendment criteria in EC 9.8424 did apply, the City Council finds <br />that the criteria in subsections (a) and (b) have been addressed above and the criterion in subsection (c) <br />is not applicable.
