Thefundamentalpolicyissues <br />involvedwithestablishing aprivatelateral programinclude: <br />Istheprogramvoluntaryormandatory? <br />Whomustparticipate? <br />Whopaysforrepairsandrehabilitation? <br />How (andwhen) istheprogramimplemented? <br />Whatlocalcoderevisionsoradditionsarenecessarytosupporttheprogram? <br />Howisequityofprogramrequirementsaddressed acrosstheMWMCpartners? <br />HowistheprogramaddressedwithintheregulatorysystemappliedtoMWMC? <br />Someofthesepolicyconsiderations areself-explanatoryandhavereceivedsomedebateatthe <br />administrative, management, andoperationallevelswithintheMWMCprogram. Oneofthemore <br />significant issues—thatofhowaprivatelateralprogramwouldbeaddressedwithintheregulatory <br />system—hasnotreceivedasmuchdiscussion. UndercurrentCleanWaterActregulationsandState <br />implementation activities, aprivatelateralprogramwouldbeadiscretionaryactivitybyapermittee. <br />Suchaprogramcouldbedevelopedandimplementedsolelyatthediscretionoftheindividualentityasa <br />meanstoreducepeakwetweatherflowsandreducerisksofnoncompliance withregulatory requirements <br />suchastheprohibitionsonSSOs), butnotbeexplicitlyincludedinaNPDESpermittherebygiving the <br />entitymaximumflexibilityinprogramimplementationandmodification. Asanalternative, theentity <br />couldseektohavetheelementsoftheprivatelateralprogramincorporated intoageneralsanitarysewer <br />programforinclusionintheNPDESpermit. Thisapproachwouldgivetheprivate lateralprogram <br />officialregulatory “sanction,” wouldestablishanexplicitbasis (andpublicjustification) forallocating <br />resourcestotheeffort, andwouldmotivateperformance measurement andreporting.
