Thefundamentalpolicyissues <br />involvedwithestablishing aprivatelateral programinclude: <br />Istheprogramvoluntaryormandatory? <br />Whomustparticipate? <br />Whopaysforrepairsandrehabilitation? <br />How (andwhen) istheprogramimplemented? <br />Whatlocalcoderevisionsoradditionsarenecessarytosupporttheprogram? <br />Howisequityofprogramrequirementsaddressed acrosstheMWMCpartners? <br />HowistheprogramaddressedwithintheregulatorysystemappliedtoMWMC? <br />Someofthesepolicyconsiderations areself-explanatoryandhavereceivedsomedebateatthe <br />administrative, management, andoperationallevelswithintheMWMCprogram. Oneofthemore <br />significant issues—thatofhowaprivatelateralprogramwouldbeaddressedwithintheregulatory <br />system—hasnotreceivedasmuchdiscussion. UndercurrentCleanWaterActregulationsandState <br />implementation activities, aprivatelateralprogramwouldbeadiscretionaryactivitybyapermittee. <br />Suchaprogramcouldbedevelopedandimplementedsolelyatthediscretionoftheindividualentityasa <br />meanstoreducepeakwetweatherflowsandreducerisksofnoncompliance withregulatory requirements <br />suchastheprohibitionsonSSOs), butnotbeexplicitlyincludedinaNPDESpermittherebygiving the <br />entitymaximumflexibilityinprogramimplementationandmodification. Asanalternative, theentity <br />couldseektohavetheelementsoftheprivatelateralprogramincorporated intoageneralsanitarysewer <br />programforinclusionintheNPDESpermit. Thisapproachwouldgivetheprivate lateralprogram <br />officialregulatory “sanction,” wouldestablishanexplicitbasis (andpublicjustification) forallocating <br />resourcestotheeffort, andwouldmotivateperformance measurement andreporting. Apermit <br />requirementforaprivatelateralprogramwouldalsoestablishabasisforreportingandariskof <br />noncompliancewiththestatedprogram-requiredelements (albeitwiththepossibility ofanaffirmative <br />defenseagainstapermitviolation), andwouldrestricttheflexibilityofthepermittee toquicklymodify <br />theprogramasconditionsmaywarrant. <br />OptionsforAddressing theInfiltrationandInflow fromPrivateSewerLaterals <br />Thefindingssummarizedabovecanbedistilledintothefollowingconclusions: <br />Regulatorystandardsexistforthemanagement ofwetweatherflowsandtheprohibitionof <br />sanitaryseweroverflows, <br />Substantialpenalties areassociatedwithnoncompliance withtheregulatorystandards, <br />TheMWMChastheresponsibilityundertheintergovernmentalagreement (IGA) tocomplywith <br />stateandfederal regulations, <br />TheEugene/SpringfieldRegionalWaterPollutionControlFacilityexperiences significantpeak <br />flowsduetoinfiltrationandinflowinthepublicandprivatesegmentsofthesanitarysewer <br />ATTACHMENT 1 <br />Page8of10 Appendix C-112020 Eugene Wastewater Master Plan
