Charnelton Street Zone Change Page 5 of 8 <br />Zone Change Application: Written Statement <br />May 31, 2023, July 7, 2023 <br /> <br /> <br />Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br /> <br /> <br />ZONE CHANGE WRITTEN STATEMENT <br />The following are the zone change criteria as set forth in EC 9.8865 and the responses (in italics). The applicant is <br />requesting a zone change from R-3 (limited High Density Residential) to R-4/SR (High Density Residential with Site <br />Review Overlay). <br /> <br />9.8855 Applicability. Changes in zoning, including the application of or change of an overlay zone or special area <br />zone shall be processed as a Type III application as provided in EC 9.7300 through EC 9.7340 Type III Application <br />Procedures, with the following exceptions: <br />The application shall be processed as a Type III application procedure. It does not meet any of the exceptions listed <br />in this section. <br /> <br />9.8860 General Requirements. <br />(1) Concurrent Review. Zone change applications may be reviewed concurrently with certain other land use <br />applications, but only as provided in EC 9.8005 Applicability and Effect of Application Requirements, Criteria, <br />and Concurrent Review and in EC 9.8855 Applicability. <br /> No other land use applications are currently submitted. <br /> <br />(2) Overlay Zones. EC 9.1040 Establishment and List of Overlay Zones establishes overlay zones that supplement <br />the base zone regulations. Changes in zoning can include the designation of an overlay zone in addition to the <br />base zone. While some of these overlay zones have been applied to a specific geographic area through a land <br />use code amendment, other overlay zones are applied on a case by case basis. In these cases, the overlay <br />zone can be applied in response to adopted plan policies or where the use of the overlay zone is necessary to <br />address future development considerations. <br />The are currently no overlay zones on this property. The property is in the Jefferson/Far West Refinement Plan <br />area. In the section titled Residential Areas there is a policy under 17. High Density Residential Areas (Page 29) <br />(This property is found in that area) stating: <br /> <br />This area shall be recognized as appropriate for high-density residential uses. <br /> <br />Proposed rezonings to higher densities within this area shall be evaluated based <br />on criteria such as parcel size, proposed development, and impact on the <br />surrounding uses. Site review shall be required in conjunction with rezonings. <br /> <br />Including Site Review Overlay is required by this policy. The zone change request is for R-4/SR. <br /> <br />9.8865 Zone Change – Approval Criteria. Approval of a zone change application, including the designation of an <br />overlay zone, shall not be approved until it meets all of the following criteria: <br />(1) The proposed change is consistent with applicable provisions of the Metro Plan. The written text of the Metro <br />Plan shall take precedence over the Metro Plan diagram where apparent conflicts or inconsistencies exist. <br />The site is currently zoned R-3 and planned High Density Residential. The requested zone change does not <br />create inconsistencies with applicable provisions of the Metro Plan. <br /> <br />Metropolitan Residential Land Use and Housing Element. <br />A.10 - promote higher residential density inside UGB that utilizes existing infrastructure, improves the efficiency <br />of public services and facilities, and conserves rural resource lands outside UGB. <br />The proposed zone change would apply a higher density zone on a site served by existing infrastructure. <br />As proposed, the zone change will allow for higher density residential uses within the UGB that utilizes <br />existing facilities and helps to conserve resource lands outside the UGB. <br /> <br />A.13 - Increase overall residential density in the metropolitan area by creating more opportunities for effectively <br />designed infill, redevelopment, and mixed-use while considering impacts of increased residential density <br />on historic, existing and future neighborhoods. <br />The proposed zone change would allow for future residential development within the UGB at a scale and <br />density that is consistent with the surrounding uses and land use designation.
