TRANSPORTATION PLANNING RULE ANALYSIS <br />In supporting the proposed PL zone designation, the TIA needs to address Oregon Administrative Rule <br />(OAR) 660 012-0060 - Plan and Land Use Regulation Amendments criteria, commonly referred to as the <br />Transportation Planning Rule (TPR). The following presents the specific criteria followed by the Applicant's <br />response. <br />(OAR) 660 012-0060 (1) If an amendment to a functional plan, an acknowledged comprehensive plan, or <br />a land use regulation (including a zoning map) would significantly affect an existing or planned <br />transportation facility, then the local government must put in place measures as provided in section (2) of <br />this rule, unless the amendment is allowed under section (3), (9) or (10) of this rule. A plan or land use <br />regulation amendment significantly affects a transportation facility if it would: <br />Applicant Response: The proposed amendment is not allowed under sections (3) or (10) of this rule. <br />Because the proposed PL zone designation is allowed within the existing LDR plan designation it can be <br />argued that the amendment is allowed under section (9) which in summary states that there is no <br />significant effect if (a) The proposed zoning is consistent with, and does not change, the existing <br />comprehensive plan map designation; (b) The proposed zoning is consistent with the acknowledged TSP; <br />and (c) The subject area was not exempted from this rule at the time of a UGB amendment or if it was <br />exempted, there is an associated TSP amendment. However, as previously identified, the TSP did not <br />contemplate PL-type property development in the LDR plan designation. As such, is assumed the <br />amendment is not allowed under section (9) and that TPR criteria must be addressed. <br />(a) Change the functional classification of an existing or planned transportation facility (exclusive of <br />correction of map errors in an adopted plan); <br />Applicant Response: The potential development trip generation increase of 15 PM peak hour trips is <br />considered de minimus as it represents less than 5% of the traffic entering the River Road/Hilliard Lane <br />intersection in the 2035 plan year which is the nearest intersection of higher-order roadways. <br />The small trip generation increase will not change the functional classification of an existing transportation <br />facility and there are no additional planned facilities in the project area. <br />(b) Change standards implementing a functional classification system; or <br />Applicant Response: The potential development trip generation increase of 15 PM peak hour trips is <br />considered de minimus as it represents less than 5% of the traffic entering the River Road/Hilliard Lane <br />intersection in the 2035 plan year which is the nearest intersection of higher-order roadways. <br />The small trip generation increase will not change the standards implementing a functional classification <br />system. <br />(c) Result in any of the effects listed in paragraphs (A) through (C) of this subsection. If a local government <br />is evaluating a performance standard based on projected levels of motor vehicle traffic, then the results <br />must be based on projected conditions measured at the end of the planning period identified in the <br />adopted TSP. As part of evaluating projected conditions, the amount of traffic projected to be generated <br />within the area of the amendment may be reduced if the amendment includes an enforceable, ongoing <br />requirement that would demonstrably limit traffic generation, including, but not limited to, transportation <br />Itr cmc River Road Elementary Hilliard Lane ZC TIA - revised 10.10.2022 - final.docx <br />
