Springfield Overlay Zone Ministerial: Staff <br />Type I Floodplain <br />Development Permit <br />Corvallis Overlay Zone Ministerial: Staff <br />Floodplain Development <br />Permit <br />Salem Overlay Zone Ministerial: Staff <br />Floodplain Development <br />Permit <br />WILLAMETTE GREENWAY PERMIT CODE AMENDMENTS (EC 9.8800 - 9.8825) <br />The following summary provides additional information in response to questions from Commissioner <br />Ramey and others about what the proposed Design Plan actually is compared to other types of adopted <br />plans the City has; exceptions for prior developed areas and whether the City should provide exceptions <br />for only the footprint of existing development rather than entire lots; and the genesis of certain <br />proposed standards and how they compare, vary, or possibly conflict with similar existing standards in <br />the code. Where staff's recommendations have changed since the initial public hearing, those new <br />recommendations are noted among the topic areas discussed below. <br />Background on the Design Plan <br />The Design Plan is a technical document that includes narrative, figures, findings, and other supporting <br />materials that respond to the requirements of Goal 15, and to support the proposed ordinance that will <br />implement the proposed code amendments. It is not intended to be a traditional adopted plan such as <br />a neighborhood refinement plan that would typically include adopted land use policies or its own land <br />use designation map, since the proposed amendments will rely on existing zoning and plan designations <br />already in place. However, the content from the Design Plan is still important support for the necessary <br />legislative findings that will accompany the ordinance adopting the Greenway code amendments. The <br />plan is intended to provide evidentiary support for code amendments that implement clear and <br />objective approval criteria for the review of housing development within the Greenway Boundary. The <br />Design Plan does not contain any provisions directly applicable to development. Rather, it provides the <br />necessary background information and findings to support the new clear and objective approval criteria <br />consistent with the requirements of Goal 15. <br />The following section discusses more specific topics and possible revisions to the draft code and <br />provides additional detail on standards and requirements in response to Planning Commissioner <br />questions and public comment. <br />Permitted and Prohibited Uses and Exceptions (See Draft Code at EC 9.8812) <br />Allowed Uses (See Draft Code at EC 9.8812(1) through (3)) <br />The uses currently proposed to be allowed within the Greenway setback are consistent, and align with, <br />the uses allowed within the /WR conservation area associated with Willamette River and listed in the <br />/WR overlay zone at EC 9.4930. The uses permitted within the Greenway setback and /WR Conservation <br />Area Setback are only water-related uses, water-dependent uses, and uses listed in EC 9.4930(2). The <br />uses subject to Standards Review within the Greenway setback and /WR Conservation Area Setback are <br />only those listed at EC 9.4930(3). The uses prohibited within the Greenway setback and /WR <br />Conservation Area Setback are those listed at EC 9.4930(4). The proposal does not expand or change <br />uses allowed, allowed subject to Standards Review, or prohibited in Goal 5 protected areas. Staff is still <br />Page 13 of 91 <br />
