accordance with applicable procedural requirements of the Eugene Code (EC) and OAR 660-023- <br />0200(8)(a). <br />II. RECORD BEFORE THE HISTORIC REVIEW BOARD <br />The record before the Historic Review Board consists of the application materials, and all testimony and <br />evidence submitted before the record closed on April 7, 2022. Due to COVID-19 restrictions, the Historic <br />Review Board meetings on this matter were held virtually. The record materials for this application were <br />provided electronically to each of the board members, and printed copies of the record materials were <br />also made available for review. <br />III. FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />The applications before the Historic Review Board consist of an historic demolition application, an <br />historic alteration application, and an adjustment review application. <br />Historic Demolition Application (OAR Consideration): OAR 660-023-0200(8) is provided below for <br />reference, followed by a discussion of each of the factors and evidence relating to it in the record. <br />OAR 660-023-0200(8) National Register Resources are significant historic resources. For these <br />resources, local governments are not required to follow the process described in OAR 660- <br />023-0030 through 660-023-0050 or sections (4) through (6). Instead, a local government: <br />a): Must protect National Register Resources, regardless of whether the <br />resources are designated in the local plan or land use regulations, by review of <br />demolition or relocation that includes, at minimum, a public hearing process <br />that results in approval, approval with conditions, or denial and considers the <br />following factors: condition, historic integrity, age, historic significance, value <br />to the community, economic consequences, design or construction rarity, and <br />consistency with and consideration of other policy objectives <br />in the <br />acknowledged comprehensive plan. Local jurisdictions may exclude accessory <br />structures and non-contributing resources within a National Register <br />nomination.... <br />The Board finds that OAR 660-023-0200(8) requires consideration and weighing of the eight factors <br />listed in the rule in order to determine whether the historic demolition application should be <br />approved, approved with conditions, or denied. Based on the plain text of the rule, the Board does <br />not believe that any individual factor is dispositive; rather, the Board understands the rule to require <br />the Board to determine, based on consideration of the testimony and evidence related to the eight <br />factors, whether, on balance, the historic demolition should be approved, approved with conditions, <br />or denied.
