The Planning Director shall review and approve in writing any proposed changes to <br />the Covenants, Conditions and Restrictions (CC & R's) and the Disclosure Statement <br />regarding those portions of the CC & R's protecting conservation areas and the City's <br />authority to enforce. (Refer also to Tentative PUD Condition #14.) <br />Response: The Performance Agreement, East Ridge Village PUD (PDF 02-2), signed between <br />September 16, 2002, and September 19, 2002, is included in Exhibit G. The Performance <br />Agreement has this condition crossed out, and a handwritten note states: "Master C, C & <br />R's recorded 2003 with Phase 1." <br />The Planned Unit Development Performance Agreement shall include: <br />1. Exhibit A. East Ridge Village Final PUD-. Tentative PUD. Conditions Still in <br />Effect and New Final PUD Conditions of Approval <br />2. Exhibit B. East Ridge Village Final PUD, Approved Exceptions and <br />Modifications to the Eugene Land Use Code <br />3. Exhibit C. East Ridge Village Final PUD. Phasing Plan <br />4. Exhibit D. East Ridge Village Final PUD. Master CC & R's. (Including <br />reference to provisions related to the preservation of Conservation Areas and <br />City Enforcement.) <br />Response: The Performance Agreement, East Ridge Village PUD (PDF 02-2), signed between <br />September 16, 2002, and September 19, 2002, states that this condition was met prior to <br />this submittal. <br />IV. Conclusion <br />The required findings have been made, and this written narrative and accompanying documentation <br />demonstrate that the application is consistent with the applicable provisions of the Eugene Land Use Code <br />and the surviving conditions of approval for the East Ridge Village PUD (PDF 02-2), as modified.
