lot until a certificate of temporary occupancy has been issued, in conformance with this <br />condition. This condition can be satisfied. <br />Condition 18: <br />The applicant shall dedicate to the city 2.97 acres, as depicted on the site plan, for <br />establishment of a nature trail through the PUD property to Moon Mountain Park. <br />The applicant shall be responsible for all improvements necessary for construction of <br />the proposed nature trail. The dedication and all nature trail construction activities <br />shall be completed prior to final subdivision plat approval for the first proposed <br />development Phase. <br />Response: Phase 1 of the East Ridge Village PUD, dedicated Tract A (18030333/03400), a 5.28-ac <br />tract, which is now held by the City of Eugene. Said Tract includes the ±2.97-acre area <br />referred to in Condition 18, above. As-built plans for the East Ridge Village PUD indicate <br />that the nature trail has been constructed. This condition has been satisfied. <br />Condition 19: <br />Prior to final plat approval for each subdivision, the application shall provide <br />verification of water service availability. <br />Response: A verification of water service availability will be provided prior to a final plat approval. <br />This condition can be met. <br />Condition 21: <br />The City shall purchase and the applicant shall sell Lot 104 at the time the sale can <br />legally be closed (following the final plat of the subdivision creating the lot). <br />(On November 15, 1999, the Planning Commission added this condition and <br />referenced "Lot 107" as shown in the tentative PUD. This lot is immediately to the <br />north of the land being dedicated for public park along Rockcress Lane. Due to the <br />re-numbering of lots, the Final PUD refers to this lot as "Lot 104".) <br />Response: The tax records for Tax Lot 3400 (Lane County Assessor's Map 18030333) indicate that it <br />is owned by the City. This 5.28-acre parcel (referred to as Tract "A" on the Assessor's Map) <br />includes Lot 104. This condition of approval has been completed. <br />Condition 22: <br />A separate variance application will be required as part of the subdivision application <br />for the Woodfern Lane area if a cul-de-sac length of greater than 400 feet is proposed. <br />Response: The Phase 7 PUD was modified (MDA 06-7) to accommodate the EWEB reservoir. The <br />modification reduced the length of Woodfern Lane (±300 foot) and added Woodfern <br />Terrace 350 feet). The cul-de-sacs/dead-end streets in this area are less than 400 feet; <br />therefore, this condition no longer applies. At the time of tentative subdivision approval <br />for Phase 7, the City will verify conformance with the approval condition. <br />The following are new conditions of Final PUD approval (see Exhibit D): <br />Based on the information depicted on sheet No. A2-3, the applicant shall <br />revise Sheet No. A2-3.1 titled, "Statement of Design Intent," to include a <br />description of the maximum allowed lot coverages for the "alternative" <br />housing types. <br />,~/►L7 East Highlands Lot 46 - City of Eugene November 2021 <br />PUD Modification, Cluster Subdivision, Property Line Adjustment and Page 49 <br />Slope Easement Vacation <br />
