Response: These improvements were completed during the construction of Phase 5 of the East Ridge <br />Village PUD subdivision. Aerial imagery from 2019 shows that improvements to the <br />Glenwood Interchange have been completed in a manner that substantially conforms to <br />the conceptual drawings included in the Cooperative Improvement Agreement between <br />ODOT, the City of Eugene, and the City of Springfield (Agreement No. 19131). During the <br />approval of the East Highlands Final Plat, the City agreed that relevant portions of this <br />agreement were met. Per above, the application reduces trip impacts below the prior <br />approval and therefore remains in compliance with this agreement. This condition is <br />satisfied. <br />Condition 9: <br />Prior to tentative subdivision approval for each Phase, the applicant shall submit for <br />review and approval by the City Engineer, a revised stormwater drainage plan that <br />clearly delineates between public and private facilities. All drainage facilities or <br />streams that carry stormwater runoff, public lands, and rights-of-way must be public <br />facilities within public easements. <br />Response: The Preliminary Composite Utility Plan in Exhibit A shows the planned stormwater <br />facilities. The anticipated public easements needed for the planned facilities are indicated <br />on the Preliminary Composite Utility Plan in Exhibit A. Pease refer to the Preliminary <br />Stormwater Report in Exhibit F for more information. This condition is satisfied. <br />Condition 10: <br />Prior to tentative subdivision approval for each Phase, the applicant shall submit a <br />drainage maintenance agreement with City of Eugene Public Works Maintenance, as <br />part of a privately engineered public improvement process. The agreement must <br />separately identify private and City stormwater conveyance responsibilities. <br />Response: A drainage maintenance agreement with City of Eugene Public Works Maintenance will <br />be submitted as part of the PEPI process and will separately identify private and City <br />stormwater conveyance responsibilities, as required by this condition. This condition has <br />been and will continue to be satisfied. <br />Condition 13: <br />Prior to tentative subdivision approval for each Phase, the applicant shall verify that <br />public drainage easements are provided from the top of the bank to top of the bank <br />along open drainage channels and swales. <br />Response: The subject phases of the project do not involve open drainage swales or channels. This <br />condition does not apply. <br />Condition 14: <br />Covenants, Conditions and Restrictions (CC&R's) and the Disclosure Statement, in <br />substantial conformance with those submitted with and proposed through the PUD <br />applications, shall be recorded with the subdivision plats for each development Phase. <br />The CC&R's shall ensure the city retains enforcement authority to ensure compliance <br />with all maintenance and preservation requirements for privately-owned conservation <br />easement areas.
