Response: This PLA application will be the first adjustment to any of the boundaries of these lots in <br />this calendar year. This standard is met. <br />(d) The adjustment will result in less than a 200% change in the size of <br />the lot or parcel. This subsection does not apply to proposed property <br />line adjustments undertaken by or on behalf of a governmental entity <br />that affect the ability to preserve, manage, or expand park, open <br />space, or natural resource areas. <br />Response: The adjustment involves a ±2,215-square-foot exchange area. Following the proposed <br />adjustment, Lot 46 will be increased by 4% in lot area, and Lot 45 will be reduced by 16% <br />in lot area. This standard is met. <br />(2) A property line adjustment application may not be utilized to effect the <br />reconfiguration of lots or parcels which must be approved through the <br />partition or subdivision procedure. <br />Response: The two lots were created through an approved subdivision procedure (East Highlands <br />Subdivision). This standard is met. <br />(3) A property line adjustment application may not be utilized to create flag lots. <br />Response: The property line adjustment application does not propose creating a flag lot. This <br />standard is met. <br />9.8410 Property Line Adjustment - Application Requirements <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific <br />requirements shall apply to property line adjustment applications: <br />(1) Except for parallel property line adjustments to platted lots, when the adjusted <br />property line is a distance of even width along the common boundary, all <br />applications shall be prepared by an Oregon licensed Land Surveyor. <br />Response: The Preliminary Property Line Adjustment Plan in Exhibit A was prepared by a OR licensed <br />Land Surveyor. <br />(2) Applications shall be signed by at least one of the owners of each parcel <br />involved, and shall include a current preliminary title report issued within one <br />year of the date the application is submitted, for each parcel. <br />Response: The application forms in Exhibit B include owners' signatures. A Preliminary Title Report <br />dated within one year is included in Exhibit C. This requirement is met. <br />9.8415 Property Line Adjustment - Approval Criteria <br />The planning director shall approve, approve with conditions, or deny the property <br />line adjustment application. Approval or approval with conditions shall be based on <br />compliance with the following criteria: <br />(1) Any buildings to be retained on the properties comply with the minimum <br />front and interior yard setbacks as defined in this land use code. <br />Response: Both lots are currently vacant. This criterion does not apply. <br />(2) The final configuration of property lines shall not reduce an existing lot below <br />the minimum lot standards established in this land use code or otherwise <br />violate standards of this land use code, building codes, fire codes, and Chapter <br />7. <br />,~/►L7 East Highlands Lot 46 - City of Eugene November 2021 <br />PUD Modification, Cluster Subdivision, Property Line Adjustment and Page 32 <br />Slope Easement Vacation <br />
