This standard is met. <br />9.6873 Slope Easements. Because of terrain, slope easements may be required to facilitate <br />the construction of streets and alleys and protect the structural integrity of the <br />constructed roadway. Slope easements shall be granted in addition to the required <br />street or alley width listed in Table 9.6870 Right-of-Way and Paving Widths. <br />Response: This application includes a request to vacate the easement in Slope Easement Document <br />No. 2007-067300-Exhibits A-9 and B-9 included in Exhibit H, which covers a portion of <br />the Brackenfern Road frontage. This easement was granted for the purpose of <br />constructing Brackenfern Road. Brackenfern Road has been constructed; therefore, this <br />easement is no longer needed for construction of the road. Additionally, the portion of <br />the property within the easement is located uphill from the Brackenfern roadway. <br />Therefore, the easement is not needed to protect the structural integrity of the roadway. <br />As with the Brackenfern frontage, the portion of the slope easement abutting the <br />Deerfern Road frontage is uphill from the future Deerfern Road improvements. Therefore, <br />a slope easement is not needed to protect the structural integrity of Deerfern Road. The <br />Geotechnical Engineering Report in Exhibit E provides additional support for the <br />requested vacation. <br />9.6875 Private Street Design Standards. Private streets, when permitted under EC 9.6815(2), <br />shall be designed and constructed in accordance with applicable requirements for <br />private streets contained in the adopted "Design Standards and Guidelines for Eugene <br />Streets, Sidewalks, Bikeways and Accessways." <br />Response: The private street is designed to meet the local street standard for a two-way alley <br />contained in the Design Standards and Guidelines for Eugene Streets, Sidewalks, <br />Bikeways, and Accessways.
