The proposed zoning would implement the related land use designation change <br />to Mixed Use. <br />As a reminder, the land use applications proposed in this City-initiated adoption package are <br />subject to formal quasi-judicial procedures at EC 9.7065-9.7095, so if there are any declarations or <br />disclosures related to conflict of interest or ex-parte contact, commissioners should provide those <br />at the outset of our next meeting. As previously discussed, the applications are subject to review <br />according to the approval criteria for each application type, and the commission's recommendation <br />must be based on the available evidence in the record. <br />SUMMARY OF PLANNING COMMISSION PUBLIC HEARING <br />During the January 26 public hearing, Planning Commissioners received a brief presentation <br />from Planning staff, received testimony from the applicant, and heard testimony from several <br />interested parties. Prior the close of the public hearing, Planning Commission received a <br />request to extend the open record period, consistent with State law (ORS 197.763). A brief <br />summary of additional materials received during the open record period is provided below. <br />Open Record Period <br />Prior to the close of the public hearing held on January 26, 2021, the record was requested to <br />be held open for any interested party to submit new evidence and testimony for consideration <br />as part of the Commission's deliberations. All parties agreed to a seven-day period to allow new <br />written testimony and evidence followed by a subsequent seven-day period for written <br />testimony in response to all arguments and evidence already in the record. A final seven-day <br />period was provided for the applicant to provide written arguments.
