• - • <br />A portion of the property is designated as wetland and meets the criteria that defines a wetland. The <br />West Eugene Wetland Plan has defined the wetland area on the property as un-designated, with <br />respect to development. The city is currently proposing changes to the Plan to designate the property <br />as develop/fill. This proposal does not impact the wetland area with the exception that storm sewer <br />would eventually need to be extended through a portion of the wetland on the north side and the <br />sanitary sewer would eventually need to be extended through a portion of the wetland at the <br />southeast corner. Utility extension is allowed and covered under a Corps of Engineers nationwide <br />permit; an application would need to be made, and under current regulations it would be approved. <br />The applicable criteria of Eugene City Code, Section 9.035(4) can be met as follows: <br />Section 9.030(4) (a): In the case of a major or minor partition, that the proposed partition <br />will comply with all applicable standards of this chapter. <br />Section 9.030(4)(b): In the case of a major or minor partition <br />1. Adjoining properties to the north and east are already developed or <br />designated as wetland conservation areas. The dedication of the right-of-way <br />will improve the potential of the property to the south. <br />2. The partition, as proposed, is consistent with all plans and the existing zoning <br />for the property. <br />3. All public facilities are available to serve the property; storm and sanitary <br />sewer is discussed above. This partition (dedicating right-of-way and <br />reconfiguring two existing parcels) will not cause any unreasonable street <br />congestion or pollution, risk of fire, flood, or geological hazards. This <br />partition alone does not conflict with any of the stipulations under Section <br />9.030(4)(b)3. Also, the property falls under site review requirements of the <br />City of Eugene; this will ensure than all aspects of Section 9.030(4)(b)3 will <br />be meet during ultimate development of the property. <br />4. Streets and roads are laid out to meet the requirements of Section 9.045 of the <br />City code as discussed below. <br />5. This partition does not restrict any potential for reasonable access of any <br />kind. Pedestrian and bicycle access can be effectively controlled by the City <br />of Eugene through the required site review process. <br />
