<br />OREGON OFFICIAL RECORDS. THE EASEMENT WAS INTENDED TO COVER THE PUBLIC STORK
<br />SEWER THAT WAS CONSTRUCTED AS THE PRIVATELY ENGINEERED PUBLIC IMPROVEMENT
<br />REFERRED TO AS CITY PROJECT #3485. THE ORIGINAL EASEMENT INCORRECTLY REFERENCE[

<br />LAND PARTITION PLAT No. 94-P0477". THE CORRECTED EASEMENT IS DESCRIBED BELOW. THI',
<br />CORRECTED EASEMENT DUPLICATES A PORTION OF A PREVIOUS EASEMENT DESCRIBED ON REEI.

<br />JAMES PADDOCK , GRANTOR,
<br />conveys to the CITY OF EUGENE, an OREGON MUNICIPAL CORPORATION, GRANTEE, an
<br />easement over, across, and under the following described land and real property:
<br />THE MOST NORTHERLY 10.00 FEET OF PARCEL 3, LAND PARTITION PLAT No. 94-P0477; LANE
<br />COUNTY OREGON PLAT RECORDS.
<br />for a ./stormwater system to be constructed and located below the surface uflhe real property,
<br />as the same has been surveyed and located over said real property by the City. The City and its
<br />contractors, subcontractors, agents or employees, shall have the right to go upon said real property for the
<br />purpose of constructing and maintaining said system. The said system shall be so constructed so as to do
<br />no damage to said real property. After the construction of said system said real property, at the points
<br />where the sewer is laid and constructed, shall be left in as good condition as before the construction of the
<br />system. The City shall have the right to permanently maintain said system over said real property, and its
<br />agents and employees shall have the right to go upon said real property at the points where the said
<br />system shall be located and constructed, for the purpose of maintaining and repairing the system with the
<br />understanding that the City, its agents or employees, in maintenance or repairing of the system, shall do
<br />no damage to the real property, and shall leave the real property in the same condition as before.
<br />No permanent building shall be erected or placed in the easement area.
<br />Subject to the foregoing limitation Grantor may use said easement area for roadway, parking, or
<br />landscape purposes, or for any other purpose not inconsistent with said easement.
<br />The true and actual consideration for this easement is $ 0 / other than monetary.
