The applicant shall submit a Public Improvement Construction Agreement which <br />addresses timing and responsibilities for future street, storm drainage, and wastewater <br />improvements within Parcel 1. The agreement shall address the applicant's obligation to <br />provide street improvements and associated drainage upon the request of the owner of <br />Parcel 1. It shall also address responsibility for the dedication of any additional right-of- <br />way within Parcel 1 required to ensure that half street improvements can be constructed if <br />development has not occurred on the property to the south. The document shall also <br />address the applicant's responsibility to provide temporary or permanent public drainage <br />easements and temporary construction easements within Parcel 2, as necessary to <br />complete the approved Public Improvement Plans. Provisions for installation of the <br />wastewater under paved surfaces in Parcel 1 must also be addressed. The agreement will <br />be binding on heirs and assigns of each parcel and is subject to the review and approval <br />of the Public Works Director. <br />• The final plat shall include a reference to the Public Improvement Construction <br />Agreement, including a general note to the conditions contained therein. <br />• The property is encumbered by wetlands. The applicant shall submit a wetland <br />delineation prepared by a qualified consultant, and concurrence to the delineation from <br />Oregon Division of State Lands (ODSL) that demonstrates that the property can be used <br />for the purpose intended. <br />• Prior to final plat approval, the applicant shall provide wetland fill permits from ODSL <br />and the Army Corps of Engineers for proposed wastewater and storm drain work within <br />the wetlands, or provide adequate verification that such construction can be done under a <br />nationwide exemption. <br />• Neither the tentative plat or the conceptual storm sewer plan was signed or stamped by a <br />licensed surveyor. The applicant shall submit copies of both documents with the <br />necessary signature and stamp. <br />• Sterling Drive cannot be used as a street name as that name is used elsewhere in the City. <br />Several informational items are also included in referral comments from Public Works staff, <br />which are addressed at the end of this report. Those items address final plat check fees, payment <br />of taxes, and various additional permit requirements. <br />Referral comments from staff at the Eugene Water and Electric Board (EWEB) indicate that no <br />additional easements are required for electrical facilities at this time. EWEB staff also comment <br />that water service for the proposed partition will be provided in accordance with EWEB policies <br />and procedures which are available at their main office. Water is available from the west side of <br />Willow Creek Road, and water meters will be installed in the right-of-way if possible; if not, a 7' <br />public utility easement will be required behind the right-of-way for installation of the meters and <br />Findings and Decision (MP 00-3) January 11, 2001 7 <br />
