Refinement plan application requirements and criteria are designed to facilitate <br />consideration of amendments to address changes that have occurred, such as changes in state or <br />federal legislation, changes in the Metro Plan or other applicable local policies, or changes in <br />circumstances that could directly influence public policy choices. <br /> <br />Response: There is a change in applicable local policies which warrants this refinement plan amendment. <br />The Envision Eugene Comprehensive recommends that many <br />small parcels be expanded for redevelopment purposes if possible, but this parcel cannot be expanded <br />due to existing physical constraints (the property is surrounded by streets). Furthermore, as evidenced by <br />recent nearby development and re-development activity, there appears to be a demand in the Eugene <br />area for mixed-use development and the Whiteaker neighborhood in particular, with multiple areas of <br />vibrant revitalization. The parcels to the southeast of the subject property are already designated as <br />Mixed-Use in the Refinement Plan, as are additional properties further to the east and south. With this as <br />context, the proposed amendment would be compatible and contiguous with existing designations. <br />Moreover, investment next to a major street could very well lead to a more attractive environment for <br />residents and businesses, as well as an aesthetically pleasing streetscape for pedestrians, transit riders, <br />and bicyclists. <br /> <br />In fact, the properties that Emerald Village now sits on were redesignated Mixed-Use in 1987 at the <br />request of Chef Francisco so they could add 100 employees to the Eugene facility located at 1400 Cross <br />Street (RA-87-1). Additionally, a Refinement Plan Amendment and Zone Change to Whiteaker Special <br />Area from Public Land was approved for the former Whiteaker #2 fire station in 2001 (RA-01-2). The Staff <br />Report for the Refinement Plan Amendment found that the application was compatible with the Metro <br />Plan Diagram: <br /> <br />The subject property is on the edge between two designations on the Metro Plan Diagram. The <br />st <br />area to the west on the north side of West 1 Avenue is designated as Medium Density <br />Residential with Mixed Use on the Metro Plan Land Use Diagram. The existing apartments, and <br />st <br />industrial development reflects this designation. The area to the east along West 1 Avenue is <br />designated Low Density Residential. This designation is primarily intended for residential <br />development through ten units per acre. The Metro Plan Diagram is not intended to be site <br />specific. Given the long-term non-residential use of the subject site as a fire station, an <br />location adjacent to the mixed use area to the west, staff would find that the request aligns with <br />the Mixed Use Designation of the Metro Plan Diagram \[emphasis added\]. <br /> <br />The 1400 Cross street is also on the edge of three designations on the Whiteaker land use diagram; to <br />the northwest of the 1400 Cross Street is industrial, to the northeast is residential, and to the southeast is <br />mixed-use. Similar to the Whiteaker #2 fire station, this site has been a long-term non-residential use, is <br />adjacent to Railroad Boulevard (a major collector) and is adjacent to property already designated mixed <br />use in the Whiteaker Refinement Plan and Metro Plan. <br /> <br />9.8422 Applicability. Refinement plan amendment procedures only apply when specific changes <br />are proposed to an existing refinement plan that covers areas only within the jurisdiction of the <br />city. The procedures are not applicable to comprehensive updates of an entire refinement plan. <br /> <br />Response: A Refinement Plan Amendment is necessary to change the designation to Mixed-Use. The <br />Industrial designation was maintained by the City of Eugene with the adoption of the 1994 Whiteaker <br />Refinement Plan. This diagram change, referenced above and explained below, is location-specific and is <br />within an area covered by the plan. <br /> <br />9.8423 General Requirements.
