More application details can be found in the attachments and materials included <br />in the application file. <br />PROCEDURAL SUMMARY <br />The Eugene Code allows lower level application types, such as Type III Zone Changes, to be <br />considered concurrently with higher level application types in a single public review process. In this <br />particular set of applications, the inclusion of a Metro Plan, Type I Amendment means the other <br />associated applications can be reviewed concurrently under the Metro Plan Amendment <br />procedures beginning at Eugene Code (EC) 9.7700. Therefore, in conjunction with the applicant's <br />Metro Plan Amendment, the applicant has also requested a concurrent Zone Change as described <br />above. In this case, the proposed change also automatically triggers the need for an amendment to <br />the applicable refinement plan, the Whiteaker Neighborhood Plan, for consistency. <br />These land use applications are subject to quasi-judicial procedures (EC 9.7065 through EC 9.7095) <br />for the upcoming public hearing, as well as the approval criteria from the Eugene Code (EC) for <br />each application type. The applicant's written statement addresses the approval criteria from EC <br />9.7735 for the Metro Plan Amendment, EC 9.8424 for the Refinement Plan Amendment, and EC <br />9.8865 for the Zone Change. The Eugene Code requires City staff to prepare a written staff report, <br />prior to the public hearing, for the Planning Commission's consideration. This agenda item <br />summary and the attached preliminary findings (see Attachment D) constitute the initial staff <br />report on this matter. <br />Following the Planning Commission's public hearing and close of the record, the Planning <br />Commission will deliberate and make a recommendation to the City Council to either approve, <br />approve with modifications, or deny the request, based on the required approval criteria. This may <br />occur following the public hearing, or at a later Planning Commission meeting.
