DECISION <br />Based on the available information and evidence, and based on the preceding findings of <br />compliance with applicable approval criteria and standards, the Site Review and Major <br />Adjustment Review are APPROVED with the following conditions: <br />1) Prior to building permit issuance, the applicant shall submit a landscape plan <br />demonstrating consistency with the applicable landscaping provision of EC 9.5500(8). <br />In the event that any provisions of EC 9.5500(8) cannot be met, the applicant may <br />apply for an Adjustment Review in accordance with EC 9.5500(8)(d). <br />2) Prior to final site plan approval, the applicant shall add compliance with EC 9.5500(9) <br />to their list of standards that will be met at the time of building permit. <br />3) Prior to the issuance of a building permit, shall submit plans demonstrating <br />compliance with the standards for private open space at EC 9.5500(9)(b). <br />Alternatively, the applicant may obtain approval of an adjustment review in <br />accordance with EC 9.5500(9)(d). <br />4) Prior to final site plan approval, the applicant shall add a note to their "ADA Handicap <br />Accessibility Notes" on site plan sheet SDR3 that states on-site pedestrian paths will <br />be constructed of concrete, a comparable hard surface material, or any properly <br />designed pervious surface that complies with the Americans with Disabilities Act in <br />accordance with EC 9.6730(3)(b). <br />5) Prior to final site plan approval, the applicant shall add compliance with EC <br />9.6730(3)(c) to their list of standards that will be met at the time of building permit. <br />6) Prior to final site plan approval, the applicant shall add compliance with EC <br />9.6730(3)(d) to their list of standards that will be met at the time of building permit. <br />7) Prior to issuance of a building permit, the applicant shall provide evidence <br />demonstrating that the recycling and garbage area complies with the requirement of <br />EC 9.5500(14), 9.5650, and EC 9.6740. <br />8) Prior to final site plan approval, the applicant shall add the following note to the site <br />plan, "Areas identified as unimpacted wetlands shall be preserved as wetlands and <br />shall not be developed." <br />9) Prior to final site plan approval, the applicant shall add the following note to the site <br />plan, "Prior to start of construction, the developer shall install protective constructive <br />fencing that clearly demarcates the area of wetlands that are to remain undisturbed <br />as shown on site plan sheet SDR5 (or applicable sheet reference if changed). This area <br />is to remain undisturbed by construction activities." <br />10) Prior to issuance of a building permit, the applicant shall provide sufficient evidence <br />that construction practices, such as boring or similarly non-invasive techniques, used <br />September 2020 Findings & Decision of the Planning Director Page 29 of 31 <br />Southwest Eugene Apartments (SR 20-3 & ARB 20-2) <br />
