1400 Cross Street LLC Page 2 of 8 <br />Metro Plan Amendment <br />Map 17-04-25-41, Tax Lot 7000; Map 17-04-25-42, Tax Lot 100 <br />July 14, 2020 <br /> <br /> <br /> <br />Development Objective <br />The development objective is to change the Metro Plan and Whiteaker Plan designation of the two tax <br />lots from Light Medium Industrial (LMI) to Mixed-Use (MU). The proposal would also change the base <br />zoning from Light Medium Industrial (LMI) to Special Area (S) and the overlay zoning to Whiteaker <br />Special Area (S-W) and Site Review (/SR). See the table above for further detail. The applicant is <br />submitting concurrent Metro Plan and Zone Change applications for the subject property. No <br />development or use is identified at this time. <br /> <br />COMPLIANCE WITH METRO PLAN AMENDMENT REQUIREMENTS <br />Applicable sections of the code are in bold italics, followed by proposed findings of fact in normal text. <br /> <br />EC 9.7700 Purpose. The Metropolitan Area General Plan (Metro Plan) is the regional <br />comprehensive land use plan of metropolitan Lane County and the cities of Eugene and <br />Springfield. In response to changing conditions needs and attitudes of the community, the Metro <br />Plan may require updating or amending. Metro Plan amendments shall be made in Accordance <br />with Chapter IV of the Metro Plan and the provisions of this land use code. <br /> <br />Response: There are changing conditions in the community. There is a demand in the Eugene area for <br />mixed-use development and the Whiteaker neighborhood is a neighborhood in transition, with multiple <br />areas of vibrant revitalization. The <br />Study recommends that many small parcels be expanded for redevelopment purposes if possible. This <br />parcel cannot be expanded due to neighborhood constraints. The parcels to the southeast of the subject <br />property are currently designated as Mixed-Use in the Metro Plan, as are additional properties further to <br />the east and south, so the proposed redesignation would be compatible and contiguous with existing <br />zoning. Moreover, investment next to a major street would lead to a more attractive environment for <br />residents and businesses, as well as an aesthetically pleasing streetscape for pedestrians, transit riders, <br />and bicyclists. <br /> <br />EC 9.7705 Metro Plan Amendment Classification of Amendment Types. <br />A proposed amendment to the Metro Plan shall be classified as Type I, Type II or Type III <br />depending on the number of governing bodies required to approve the decision. <br />(1) A Type I amendment requires approval by City of Eugene only: <br />(a) Type 1 Diagram Amendments include amendments to the Metro Plan Diagram for land <br />inside the Eugene city limits. <br /> <br />Response: The proposed amendment will be processed as a Type I decision, as it requests an <br />amendment to the Metro Plan Diagram for land inside Eugene city limits. <br /> <br />7730 Metro Plan Amendments Approval Process. <br />EC 9. <br />(5) Relationship to Refinement Plan of Functional Plan Amendments. <br />(b) When a Metro Plan amendment is enacted that requires an amendment to a refinement <br />plan or functional plan diagram or map for consistency, the Metro Plan diagram <br />amendment automatically amends the refinement plan or functional plan diagram or map if <br />no amendment to the refinement plan or functional plan text is involved. <br /> <br />Response: The applicant is requesting the Special Area base zone, Whiteaker Special Area <br />special area zone and Site Review be applied to the site. As this will require an amendment to the <br />Whiteaker Refinement Plan Land Use Map, but not the text of the Refinement Plan, the Metro <br />Plan Amendment will automatically amend the Whiteaker Refinement Plan Map. <br /> <br />EC 9.7735 Metro Plan Amendments - Criteria for Approval.
