WRITTEN STATEMENT FOR WEBB PROPERTY LINE ADJUSTMENT <br />COMPLIANCE WTTH EUGENE CODE, SECTION 9.8405 <br />9.8405 Applicability of Property Line Adjustment Applications. <br />(1) A property line adjustment application is applicable to changes to the property lines of <br />adjoining properties when all of the following exist: <br />(a) A property line proposed for removal is not platted in a partition or subdivision plat. <br />Rsp. This application is for the adjustment of the common boundary between adjoining <br />properties. No removal of property lines between adjacent properties is requested. <br />(b) A property line proposed for adjustment will not result in an increase in the number <br />of parcels or lots. <br />Rsp. This adjustment of a common boundary will not result in an increase in the number <br />of parcels or lots. <br />(c) A property line proposed for adjustment will not create more than 2 property line <br />adjustments to any of the boundaries of an individual lot or parcel within a calendar <br />year. This subsection does not apply to proposed property line adjustments <br />undertaken by or on behalf of a governmental entity that affect the ability to preserve, <br />manage or expand park, open space or natural resource areas. <br />Rsp. Approval of this property line adjustment will not create the third property line <br />adjustment to the boundaries of either of the properties involved within the current <br />calendar year. <br />(d) The adjustment will result in less than a 200% change in the size of the lot or parcel. <br />This subsection does not apply to proposed property line adjustments undertaken by <br />or on behalf of a governmental entity that affect the ability to preserve, manage or <br />expand park, open space or natural resource areas. <br />Rsp. This adjustment will result in a 31 % decrease in the size of combined tax lots 600 <br />and 800 and will result in an increase of 6% in the size of tax lot 100. <br />(2) A property line adjustment application may not be utilized to affect the reconfiguration of lots <br />or parcels which must be approved through the partition or subdivision procedure. <br />Rsp. This application is to adjust the non-platted common line between adjacent properties. No <br />property lines platted in a subdivision or partition are being vacated nor are boundary lines of a <br />platted subdivision or partition being adjusted. No reconfiguration of lots or parcels created <br />through the subdivision or partition process is requested. <br />(3) The property line adjustment application may not be utilized to create flag lots. <br />Rsp. No flag lots will be created by the approval of this property line adjustment. All resulting <br />properties will have frontage on a public street consistent with the requirements of the Eugene <br />Code. <br />I <br />F E B 2 3 2006 <br />r <br />
