WRITTEN STATEMENT FOR WEBB PROPERTY LINE ADJUSTMENT <br />COMPLIANCE WITH EUGENE CODE, SECTION 9.8415 <br />9.8415 Property Line Adiustment Approval Criteria. The planning director shall approve, approve <br />with conditions or deny the property line adjustment application. Approval or approval with <br />conditions shall be based on compliance with the following criteria: <br />(1) Any buildings to be retained on the properties comply with the minimum front and interior <br />yard setbacks as defined in this land use code. <br />Rsp. The minimum front and side yard setbacks in the Downtown Westside Special Area Zone <br />are 10 feet and 0-10 feet respectively and the building setbacks on the resulting tax lot 800 exceed <br />these minimums. Minimum setbacks in a C-2 zone are 0. <br />(2) The final configuration of property lines shall not reduce an existing lot below the minimum <br />lot standards established in this land use code or otherwise violate standards of this land use <br />code, building codes and fire codes. <br />Rsp. Lot standards within the Downtown Westside Special Area Zone require a minimum size of <br />4,500 square feet and a minimum frontage of 20 feet. The resulting tax lot 800 will exceed the <br />minimums required. <br />(3) The final configuration of property lines shall not violate any previous requirements or <br />conditions of approval imposed with a prior applicable land use decision. <br />Rsp. There are no restrictions imposed by prior land use decisions which affect this property line <br />adjustment application. <br />(4) Public assessments, liens and fees with respect to the property line adjustment have been paid <br />or: <br />(a) A segregation of assessments and liens has been applied for and granted by the city; <br />or <br />(b) An adequate guarantee in a form acceptable to the city manager has been provided <br />assuring the liens, assessments and fees will be paid prior to recording the property <br />line adjustment. <br />Rsp. Application will be made, to the Lane County Assessor's Office for an itemization of any <br />unpaid taxes or liens and payment or an guarantee, satisfactory to the city manager, will be made <br />prior to final approval of the property line adjustment. <br />
