Since <br />it came in during the first open record period, that means that any interested party actually <br />has until 5pm on May 21st to respond to it. <br />I also want to emphasize that the effort to make materials available on the City's website is a <br />matter of convenience and courtesy, not a legal obligation. The notice for the public hearing <br />made that point as clear as possible, and we invite any interested party to contact staff to <br />obtain information, copies, or answer questions they may have throughout this process. That <br />said, we make every effort to keep up with the ongoing requests for all land use applications <br />and related materials to be posted in a timely way, but currently there is a rather large backlog <br />of "yet-to-be-scanned" materials. In response to Commissioner Baker's inquiry, I provided the <br />attached materials via email to David Edrington and other Historic Review Board members so <br />that they too, would have an opportunity to respond during the open record period if they so <br />choose. I have not had any other inquiries or requests for that information to date, but will <br />also let them know they have until next Tuesday to respond. <br />As a courtesy, I've also attached (and will share with the HRB) a proposed change to the draft <br />code amendments for consideration that became available just this afternoon. It would <br />modify the height regulating plan and associated code graphic to implement what is proposed <br />in the renderings, basically a 15' height limit adjacent to the alley and extending south for 20' <br />into the subject parcel. Please keep in mind that this is a draft response from staff, intended <br />for your consideration as part of deliberations, but also provided at this time so that any <br />interested party has the opportunity to respond to it. You will also receive any other written <br />testimony, along with any admissible evidence, submitted during the open record period. For <br />convenience, I intend to send you any additional open record materials submitted by 5pm <br />today, via email tomorrow (assuming it's not too large to email). <br />I hope this clarification helps, and my invitation remains open if any of you have questions or <br />
