<br /> <br />October 10, 2018 <br />Hearings Official <br />Planning and Development Department <br />City of Eugene <br />th <br />99 W 10 Avenue <br />Eugene, OR 97401 <br />RE: North Campus Conditional Use Permit (CU 18-1 WG 18-12) <br />First Open-Record Response <br />Dear Hearings Official, <br />Please accept this letter as supplemental information in response to written testimony <br />submitted into the record during the first open-record period. The information addresses <br />compliance with EC 9.3715(1) and EC 9.3730. <br />EC 9.3715(1) <br />12 <br />Malone and Hancock assert that the application does not comply with EC 9.3715(1) because <br />one of the parking garages proposed in the Master Site Plan is not within 400 feet of the <br />proposed Knight Campus for Accelerating Scientific Impact (KCASI). The proposed Knight <br />Campus is not within the S-RP zone and area subject to the CUP request; it is within the S-WS <br />zone. <br />EC 9.3715(1) is a development standard in the S-RP zone addressing parking requirements. <br />The standard states that Å\[r\]equired parking shall be located within 400 feet of structures to be <br />served unless a greater separation is specifically approved through the master development <br />plan approval processÆ (emphasis added). In other words, if the CUP Master Site Plan <br />application does not address the standard, then the ÅdefaultÆ 400-foot separation standard will <br />apply. If the applicant shows that a different standard should apply (as is the case here), then <br />the standard specified in the approved Master Site Plan becomes the controlling standard. <br />3 <br />As noted in the application narrative, demonstration of compliance with S-RP developments <br />standards is not an explicit requirement of the CUP or WG permit approval criteria.
