1. Create a vibrant street facade with visual detail. <br />2. Provide multiple entrances to building or yards. <br />The Hearings Official found that the proposed adjustment, which includes vertical articulation, <br />horizontal massing variations in the form of decks, patios, and large window, and siding <br />treatment creates a vibrant street facade (page 19). The Hearings Official agreed with staff that <br />the proposed building provides sufficient means by which an adjustment is warranted. <br />Summary of Appellants' Argument <br />Appellants argue that the Hearings Official relies on generalities in his findings. The proposed <br />architectural design and finishings, the Appellants argue, are not yet established and therefore <br />do not warrant adjustment under EC 9.5500(6). <br />Planning Commission's Determination <br />The Planning Commission finds that the Hearings Official did not err in determining that an <br />adjustment to EC 9.4290(2) is warranted for proposed Building 2 and that the adjustment <br />approval criteria at EC 9.8030(8) are satisfied. The Applicant requests an adjustment to the <br />standard at EC 9.5500(6) for Building 2, which exceeds the maximum allowable building length <br />by approximately 31 feet. The Applicant's proposal provides evidence of articulation, multiple <br />building entrances, private patios, and decks. <br />Based on the available information in the record, the Planning Commission finds that the <br />Hearings Official did not err with respect to this appeal issue. <br />Appeal Issue #10: The Hearings Official misconstrued applicable law and made inadequate <br />findings not based on substantial evidence with regard to EC 9.6735(2). <br />Hearings Official's Decision <br />EC 9.6735 states: <br />9.6735 Public Access Required. <br />(1) Except as otherwise provided in this land use code, no building or <br />structure shall be erected or altered except on a lot fronting or abutting <br />on a public street or having access to a public street over a private street <br />or easement of record approved in accordance with provisions contained <br />in this land use code. <br />(2) Access from a public street to a development site shall be located in <br />accordance with EC 7.420 Access Connections - Location.
