condition of approval in his decision: <br />• Prior to issuance of a development permit, the applicant shall provide details that <br />identify which features are being used to comply with EC 9.5500(7); and the following <br />note will be added to the Final Site Plan: "Buildings shall comply with the building <br />articulation requirements at EC 9.5500(7)." <br />In regards to EC 9.5500(13) On-Site Pedestrian Circulation, the Planning Commission notes that <br />the Applicant does not create a connection to the public accessway directly to the east: the <br />Ruth Bascom path. However, the Planning Commission also notes that the standards are <br />intended to provide connections on-site, and to adjacent public or private street right of way <br />lines only. As the standard does not require that connections to adjacent paths be provided, the <br />Applicant's proposal complies with this standard. <br />Lastly, with reference to EC 9.5500(14) Recycling and Garbage Areas, while conceptually <br />acceptable, no graphics of the structures are provided and further review to ensure the <br />structures comply with the criterion above will be necessary at the time of building permit. To <br />ensure this occurs, the Hearings Official correctly included the following condition of approval <br />in his decision: <br />Prior to issuance of a development permit, the applicant shall revise the site plan to <br />demonstrate compliance with EC 9.5650 Recycling - Small Collection Facility Standards <br />and EC 9.6740 Recycling and Garbage Screening. The following note shall also be added <br />to the applicant's site plan: "Recycling and Garbage areas shall comply with EC 9.5650 <br />and EC 9.6740." <br />Based on the available information in the record, the Planning Commission finds that the <br />Hearings Official did not err with respect to this appeal issue. <br />Appeal Issue #9: The Hearings Official misconstrued applicable law and made inadequate <br />findings not based on substantial evidence with regard to EC 9.5500(6). <br />Hearings Official's Decision <br />The Multiple Family Development Standards at EC 9.5500(6) state: <br />(6) Building Mass and Facade. <br />(a) Maximum Building Dimension. Neither the maximum length nor width of <br />any building within 40 feet of a front lot line can exceed 100 feet in the R- <br />1 and R-2 zones and 150 feet in all other zones. <br />The criteria for adjustment to this standard states the following: <br />EC 9.8030(8): <br />(a) Maximum Building Dimension.
