approved in accordance with provisions contained in this land <br />use code. <br />(2) Access from a public street to a development site <br />shall be located in accordance with I?C 7.420 Access <br />Connections - Location. If a development will increase the <br />development site's peak hour trip generation by less than 5W/o <br />and will generate less than 20 additional peak hour trips, the <br />development site's existing access connections are exempt <br />from this standard. <br />(3) The standard at (2) may be adjusted if consistent <br />with the criteria of EC 9.8030(28)." <br />l'C 7.4200 (1)(c) requires "(ilf a parcel has frontage on two or more streets of different <br />street classifications, the access connection shall access the street with the lowest <br />classification. The access connection can access the street with the higher classification if the <br />applicant can demonstrate (1), (2) or (3): <br />1. Both of the following conditions are met: <br />a. The proposed access connection is abutted by two or more <br />directional travel lanes or an auxiliary decelcration lane; and <br />b. The applicant proposes a restricted movement access <br />connection, including but not limited to median barriers or <br />directional in/out barriers. <br />2. Physical conditions preclude locating the access <br />connection on the street with the lower classification. Such <br />conditions may include, but are not limited to, topography, <br />trees, existing buildings or other existing development on the <br />subject property or adjacent property. <br />3. The access connection for a parcel with frontage on <br />an arterial or major collector can be located consistent with <br />the requirements of I.;C 7.420(2)(a)-(e)." <br />The development has frontage on Lombard Lane which is a local access road while River <br />Road is a major arterial road. According to city standards, access should be taken to <br />Lombard Lane and not River Road. <br />The applicant has recently revealed in their June 15, 2018 memorandum that their proposed <br />access to River Road would be a full access intersection, while previously their site plans <br />illustrated that the site access would be for emergency vehicles only. This a major change <br />from previous correspondence and information included in the record. Subsection 1 above <br />cannot be met given that the applicant has not proposed a restricted access although it would <br />appear feasible to do so. Additionally, subsection 2 cannot be met as access is also proposed <br />to Lombard Lane, the lower functionally classified roadway. The applicant proposes to rely <br />upon subsection 3 to address their desire for access to River Road. <br />The May 9, 2018 Sandow Engineering memorandum addresses the requirement for an <br />adjustment to City standards in order to accommodate the access to River Road. <br />10 <br />
