TheWillametteRiverislocatedabout200feettotheeastofthesubjectproperty,accordingto <br />theğƦƦƌźĭğƓƷƭwrittennarrative.Thelandbetweentheriverandthesubjectpropertyisowned <br />bytheCity,asanundevelopednaturalresourceareathatprimarilycontains/WRWater <br />Resource(Goal5)conservationareas.Inthisarea,andinaccordancewiththeWGpermit <br />approvalcriteria,thereisnospecific,predeterminedoradoptedsetbackfromtheriverunder <br />the/źƷǤƭimplementingprovisionsofGoal15(WillametteGreenway). <br />Theeasternportionofthesitewillremainopenspace(15,504squarefeetaccordingto <br />ğƦƦƌźĭğƓƷƭlandscapeplan(sheetL2.1)),withtheclosestbuildingbeingabout63feetfromthe <br />eastproperty(asmeasuredperpendicularlyfromBuilding1tothatportionoftheeastproperty <br />linewhichroughlyfollowsthebicyclepathinanorthwestsoutheastdirection).Staffbelieves <br />theğƦƦƌźĭğƓƷƭsiteplanandotheravailableinformationshowingtheampledistanceand <br />existingriparianvegetationbetweenthedevelopmentandtheriverprovidessufficient <br />evidencetodemonstratecompliancewithEC9.8815(1). <br />3.TrafficonRiverRoad <br />StaffanticipatesthatadditionalwrittenresponsewillbeprovidedbythePublicWorks <br />Engineeringinregardstothe,forthcomingduringthesecond(responsive)openrecordperiod <br />andnolaterthanJuly16,2018at5p.m. <br />Severalindividualsexpressconcernthattheadditionof94unitswillamplifyexistingtraffic <br />problemsalongRiverRoad,decreasingsafetyofingressandegress.Arequestisalsomadeto <br />considertheimpactthat94additionalunitswillhaveonRiverRoad. <br />Whilestaffunderstandstheconcernabouttraffic,theEugeneCodehasspecificstandardsfor <br />thelocationofdriveways,andfortrafficspecificthresholdsthatmustbereachedtorequire <br />additionalanalysis.Asdetailedbytheirtrafficengineeringmemo,anddeterminedintheStaff <br />Report(beginningatpage25ofAttachmentA),theapplicantcomplieswiththestandardsfor <br />thelocationoftheirproposedaccessconnections. <br />Withregardtotrafficgeneration,theEugeneCodesetsthethresholdsforrequiringaTraffic <br />ImpactAnalysisReview(TIA)atEC9.8670Applicability.Thetrafficthatwillbegeneratedbythe <br />94unit,multifamilydevelopmentiswellbelowthethresholdsestablished.Itshouldalsobe <br />notedthatinrelationtoDeltaRidgePUD(PDT173/ARB172/TIA172)theHearingsOfficial <br />foundthefollowing: <br />ͻŷĻapplicationisforneededhousing,neededhousingmustbesubjecttoonly <br />clearandobjectivestandards,theTIAstandardsarenotclearandobjective. <br />Therefore,Ihavenochoicebuttoagreewiththeapplicantthatitisnotrequiredto <br />obtainTIAapprovaltoproceedwiththeproposedķĻǝĻƌƚƦƒĻƓƷͼ͵ <br />AstheproposeddevelopmentwillbewellbelowthethresholdsidentifiedbytheEugeneCode, <br />andtheEugeneHearingsOfficialfoundthatTIAapprovalisnotnecessaryforapplicationsthat <br /> <br />
