Background <br />The subject site is an undeveloped property, approximately 3.59 acres, and located at the <br />northern terminus of Lombard Street, with frontage along River Road to the west. To the east sits <br />a bike path, and then the Willamette River. To the southeast is Maurie Jacobs Park which is a City <br />park that includes parking, a sports field, and other park amenities. The entire site is zoned R-2 <br />Medium-Density Residential with /ND Nodal Development overlay. The southern portion of the <br />site (approximately 1.42 acres) is also zoned with a /SR Site Review overlay. The entire site is also <br /> <br /> <br />The current applications include revisions and resubmittals of an initial application package <br />submitted October 16, 2017. Regarding that initial application package, the applicant met with <br />staff on September 25, 2017 to discuss the proposal, in compliance with EC 9.7005 Pre-application <br />Conference. EC 9.7007 Neighborhood/ Applicant Meetings provides the requirements for <br />meetings, in this case, the applicant was not required to hold a meeting as none of its application <br />types require a meeting. <br /> <br />The applicant ultimately withdrew their initial applications on March 3, 2018. The withdrawal <br />followed two public noticing errors, during which an initial public notice was mailed, but an <br />the mailing list. The applicant provided a time extension of 20 days for a new notice to be mailed. <br />Public notice of the subject application was mailed again on January 25, 2018, and was sent to the <br />correct individuals; however, it included incorrect address for the subject property based on <br />erroneous information included in the application materials that were submitted. During initial <br />review, staff also identified potential code compliance issues. The applicant subsequently chose to <br />withdraw the application prior to the staff report and public hearing. <br /> <br />he Planning Division received <br />As a courtesy, those <br />individuals were added to the Interested Parties list for the subject application; however, the <br />testimony received for the prior applications is not included within the record for the current <br />applications. <br /> <br />Current Request <br />The applicant is requesting approval of Willamette Greenway Permit, Site Review and Adjustment <br />Review applications to construct up to 94 market-rate residential apartment units. In this case, <br />the applicant has requested that all three applications be reviewed concurrently, following the <br />Type III application procedures (see EC 9.8005 and EC 9.7300-9.7340). As addressed in the <br />following evaluation, the Willamette Greenway Permit is subject to the approval criteria at EC <br />9.8815, the Site Review is subject to EC 9.8445 (Needed Housing), and the Adjustment Review is <br />subject to applicable criteria in EC 9.8030.
