No bicycle paths or public accessways are proposed or required. <br /> <br />(c) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard Areas <br />- Standards. <br />The Federal Emergency Management Agency (FEMA) has issued a Letter of Map Amendment dated <br />September 28, 2017, Case No. 17-10-1873A, removing the property from the regulated Special Flood <br />Hazard Area. The Letter of Map Amendment was based on an analysis of existing topography of the <br />site, and not based on the proposal of any future fill. <br />(d) EC 9.6710 Geological and Geotechnical Analysis. <br />The written statement references the Needed Housing section at EC 9.6710(6), which provides that in <br />lieu of EC 9.6710(2), (4), and (5), applications proposing needed housing shall include a certification <br />from the appropriate design professional stating that the development will not be impacted by <br />existing or potential stability problems or any of the conditions detailed in EC 9.6710(6)(a). Per EC <br />9.6710(6)(b), if any of those conditions are present, the methods for safely addressing the impact of <br />those conditions will be addressed. Additionally, if a statement is submitted under (6)(b), the <br /> <br /> <br />The applicant has submitted a memorandum prepared by Foundation Engineering, Inc., which is <br />stamped and signed by Jonathan Huffman, P.E., G.E., indicating that potential stability problems or <br />ground water seeps or springs, and shallow bedrock were not identified on the site. Some variability <br />in soil types were identified and recommendations are provided to address this condition. <br /> <br />The applicant has stated that the site will be developed in accordance with the recommendations of <br />the report. This criteria is satisfied. <br /> <br />(f) EC 9.6735 Public Access Required. <br />(1) Except as otherwise provided in this land use code, no building or structure shall <br />be erected or altered except on a lot fronting or abutting on a public street or <br />having access to a public street over a private street or easement of record <br />approved in accordance with provisions contained in this land use code. <br />The site has frontage on River Road to the west and Lombard Street to the south, which the <br />applicant has proposed to extend through the site. The proposed development complies with this <br />standard. <br /> <br />(2) Access from a public street to a development site shall be located in <br />accordance with EC 7.420 Access Connections Location.
