for slope easements will be determined at the time of the subsequent subdivision <br />application and required to be shown on the final plat. <br />c. Page 45, EC 9.6875 Private Street Design Standards: Public Works referral <br />comments (page 6-7) confirm that the proposed private street conceptually <br />complies with the applicable standards. Under the private street typical section on <br />the applicant's site plans (Sheet C4 Private Roadway Plan & Profile) Cupola <br />Drive will consist of 21-foot paving, curbs on both sides of the street, and a 3.5- <br />foot-wide sidewalk on the westerly side of the street in a 25-foot wide right-of- <br />way (i.e. joint access easement), At the time of the subsequent subdivision <br />review, and prior to final plat approval, the private street must be formally created <br />by a separate document (i.e., Private Joint Use Access and Utility Easement and <br />Maintenance Agreement (JAM), or similar document). As the Staff Report <br />summarizes, the JAM will include a description defining the area of the private <br />street and will also identify permitted improvements, construction expectations, <br />rights of usage and maintenance responsibilities for the facilities in the private <br />street, asill well as responsibilities for the public sidewalk adjacent to the private <br />street. The JAM will be recorded concurrent with and cross-referenced on the <br />final plat. At the time of the subdivision review, provisions ensuring emergency <br />access over the private street must also be addressed. These may be included in <br />the JA.ML or alternatively may be dedicated as a Public Emergency Access <br />Easement on a standard City form. The access connection to the private street <br />must be constructed as a standard driveway apron. The structural design and <br />construction inspection for the private street shall remain the developer's <br />responsibility. Certification by a licensed engineer that a structural design meeting <br />the applicable public standards has been completed, will be required at the time of <br />the site development permit for the private street. <br />5. Criterion 6 <br />a. Page 51:, Slope Failure: The Hearings Official stated "By its terms, the applicant's <br />geotechnical report is a preliminary investigation and also includes numerous <br />specific recommendations to minimize any potential for slope failure." Ronald <br />Derrick 3/20/18: "I feel it should be stated that the report was intended to be a <br />preliminary investigation for planning purposes with a concentration on the <br />proposed roadway layout; as stated in Sections 4.0 and 5.1 of the report additional <br />site evaluation at the time of more extensive design work and possible <br />construction may be required." <br />b. Page 53, Condition 10: A geotechnical analysis from a certified engineer, with <br />specific recommendations for design and construction standards, shall be <br />provided with any applications for Privately Engineered Public Improvement <br />(PEPI) permits, as well as building permits and site development permits for the <br />initial construction of infrastructure, and residences on individual lots. The <br />development proposed with each permit shall adhere to the recommended <br />standards for design and construction as contained in the related geotechnical <br />analysis. <br />6. Criterion 10 <br />a.
