EC9.8320(6):ThePUDwillnotbeasignificantrisktopublichealthandsafety,including <br />butnotlimitedtosoilerosion,slopefailure,stormwaterorfloodhazard,oranimpediment <br />toemergencyresponse. <br />SoilErosionandSlopeFailure <br />Aswillbediscussedfullyunder EC9.8320(10)(d),theproposedCHPUDislocatedinanarea <br />ofsteepunstableslopesandelevatedlandsliderisk,andthereforeisasignificantrisktopublic <br />healthandsafety. <br />GunnarSchlieder,Ph.D.,CEG,hasreviewedtheapplicant’s“GEOTECHNICAL/GEOLOGIC <br />INVESTIGATION,CAPITALHILLPUD”ofFebruary6,2017(preparedbyBranch <br />Engineering)andanaddendumpresentedonMay30,2017.Hisreportissubmittedas <br />AttachmentC,andoutlinedunderourdiscussionof EC9.8320(10)(d),p.109. <br />ThesteepeasternslopeoftheproposedPUDhasexperiencedmultiplelandslidesinthepast,is <br />atelevatedriskoffuturelandslides,andisunsuitedforintensivedevelopmentasproposedinthe <br />PUDapplication.Dr.SchliederstatesthatthestatementintheBranchEngineeringreportthat <br />that“Thetestpitsandobservationsshowedthemajorityofthedevelopmentsitewasunderlain <br />bythestablevolcanicrockmaterial”isinerror.PerDr.Schlieder,theirtestpitlogsindicate <br />thattheyidentifiedtherocktypefoundintheirtestpitsassandstone,whichisasedimentary <br />rock. <br />Iftheeasternslopeissubjectedtoloadsthatwouldresultfrombuild-outoftheproposed <br />development,itwouldsignificantlyincreasetheriskoffuturelandslidesandposeamajorthreat <br />topropertiesandresidentsonandnearthesite. <br />TheissueofpotentialslopefailureisalsoaddressedwithinthereportofJamesMehrwein <br />(AttachmentH,p.1of14): <br />"FromdirectobservationoftheproposedCHPUDsite,slopeinstabilityisevidencedbythe <br />presenceofcurvedtrunktreesandthefailingfoundationofanexistingbuilding.After <br />reviewingrelevantpublishedreportsregardingtreeremovalandslopestability,itismy <br />opinionthattheproposedplantocutthenumberoftreesdesignatedforharvestwould <br />increasethelikelihoodofslopefailureinthefuture." <br />Astreesareremovedforconstructionontheselots,thedangerofbothsoilerosionandslope <br />failurewillincreasedramatically.Theentireverysteepeasternportionofthedevelopmentis <br />adjacenttoandabovetheRibbonTrailposingincreasingdangertothishallmarkoftheEugene <br />trailsystemandthemanywhouseitasthepropertiesaboveitaredeveloped.TheproposedPUD <br />clearlypresentsathreattopublichealthandsafety. <br />TheCapitalHillPUDfailsEC9.8320(6)andshouldbedenied. <br />#### <br />71 <br /> <br />
