howfartheconstructionworkersandheavyequipmentmusttraveltoaccessthesite?Howcan <br />suchinformationasthisbeknownattheapplicationstage? <br />Inanotheritem,Applicationstates(p.16of67):“Providinghousingnearurbanservicesto <br />reducevehiclemilestraveled.…Thedevelopmentisincloseproximitytoservices,employment, <br />andtransportation.” <br />Theseclaimshavealreadybeenrefutedindiscussing(b)aboveandfurtheraddressedregarding <br />trafficandoff-siteimpacts\[See EC9.8320(1),(5)(b),(6),and(11)\].Residentsoftheproposed <br />CHPUDmusttraverseanelevationdifferentialofmorethan432feetoveradistanceof <br />approximately1.8miles(measuredtotheentranceofthesite),whethergoingtoorcomingfrom <br />thesite.Therefore,vehicleusebyresidentsoftheproposedCHPUDwouldbeexpected,rather <br />thanwalkingandbiking.Itisnot“proximity”butgeographythatistheissueforaccessibility, <br />traffic,andsafety. <br />TheonlyexamplelistedhereintheApplicationthatisworthfurtherattentionistheissueof <br />urbaninfill. <br />Applicationstates(p.16of67):“Thisdevelopmentiscreatedindirectresponsetotheneed <br />fordensityandinfillwithintheexistingUrbanGrowthBoundary(UGB).…Infillingvacant <br />lotssothatresourceland(e.g.agriculturalland)isnotutilizedforhousingand <br />development.” <br />Urbaninfillisanimportantandvalidplanninganddevelopmentgoal.TheCommitteedoesnot <br />opposeit.However,thereareinescapablecomplicationsregardingapprovaloftheproposed <br />CHPUDintheseterms.Thesiteisadispersedmixoffiveexistinglots(threeofwhichhave <br />dwellings)onroughly13.6acres,perhapsaboutonethirdofwhicharewoodedareaswithsteep, <br />unbuildableslopes. <br />ThesitelieswithintheSouthHillsridgeline.ItisadjacenttotheboundariesoftheRibbonTrail <br />andHendricksPark.Itsview-shedisanassettothecommunity.TheproposedCHPUDwouldbe <br />intrudingintooneofthesensitiveenvironmentalborderareasofEugene’sdefiningurban <br />greenwaylandscapeandview-scape.Wecontendthatthecity’siconicurbanlandscaperesources <br />shouldbeinviolable. <br />RegardinginfillwithintheUGB,theproposedCHPUDisnotanalogoustosimplebackyard <br />infillofresidentiallotsonflatlandindense,regularurbanstreet-gridlocations,norisitlike <br />large,cleared,uninhabited,trulyvacanturbanspace.Westressthatitismisleadingtoconstrue <br />theterm“vacant”whenappliedtolotsandlandthatarenotdevelopedasbeing“empty,”when <br />suchlocationsmaybenatural,forestedenvironmentalresourcesinappropriateforurban <br />development <br />ThisparticularproposedCHPUDhasasingularappeal–itslocationinaforestedenvironmentat <br />thetopofCapitalDr.,butthedeficienciesthatcomewiththislocationaremany,especially:(1) <br />highpricestothebuyers–notaffordable,neededhousing,butcostoflotsanddwellingsthat <br />wouldbebeyondthemeansofthoseatlowandmiddleincomelevels;(2)dangerousaccessand <br />146 <br /> <br />
