PurposeSectionsofCode <br />EC9.4300Purposeof/PDPlannedUnitDevelopmentOverlayZone <br />EC9.8300PurposeofPlannedUnitDevelopment <br />ApplicationincludestheaboveCodesunder 9.8320(10)(k)inordertodeploythe“flexibility” <br />allowancein EC9.4300(1)and EC9.8300 topleadforexceptionstotheclearandobjective <br />requirementsof EC9.2750LotCoverage,EC9.2760LotFrontage,andEC9.2760LotArea. <br />Toclaimaproposednoncomplianceunder(k),Applicationmustshow“thataproposed <br />noncomplianceisconsistentwiththepurposessetoutinEC9.8300.”Ifapproved,asan <br />“adjustmenttoastandard,”suchproposednoncompliance“constitutescompliancewiththe <br />standard.” <br />TheJointCommitteeisopposedtograntingsuchflexibilityandexceptionsforLotCoverage, <br />LotFrontage,andLotArea.Werecommendthattheseexceptionsshouldnotbeapprovedto <br />grantcompliancebyadjustingthestandards.WewilldemonstratethatApplication’srequestsfor <br />noncomplianceshouldbedeniedbecausetheyarenotconsistentwiththePurposesstatedinthe <br />relevantCodes(EC9.4300 and EC9.8300).However,beforeweaddressnoncompliance,we <br />mustrefutetheApplication’sdiscussionunder EC9.4300 asitdevotesmerelyone-halfpageof <br />texttosimplyrehashingthefactualerrors,misleadingandinvalidreasoning,andexaggerated <br />anddeceptiveclaimsthataremadeintheprevious56pages(p.57of67). <br />EC9.4300Purposeof/PDPlannedUnitDevelopmentOverlayZone.The/PDPlannedUnit <br />DevelopmentOverlayZoneisintendedtoachievethefollowing: <br />ApplicationtreatsthesixitemsunderthisCodeinanundifferentiated26linesoftext,inwhichit <br />scramblesthespecificcontentoftheitemsinamannerthatsimplyrehashesunsubstantiated <br />generalizationsfoundthroughoutitspriordiscussions.Wewilldiscussthesixpointsof EC <br />9.4300 sequentially. <br />(1)Provideflexibilityinarchitecturaldesign,placementandclusteringofbuildings, <br />useofopenspaceandoutdoorlivingareas,andprovisionoffacilitiesforthe <br />circulationofautomobiles,pedestrians,bicycles,andmasstransit,parking,storage, <br />andotherconsiderationsrelatedtositedesign. <br />Applicationsimplyrespondswithgeneralreferenceto“itsthoughtfulandsensitivedesign,”and <br />“clusters”ofbuildings.Incontrast,wehavediscreditedthedesignofthedenselyclusteredlots <br />forproposedhousingasaproductofmaximizingeconomicreturnbycrammingasmanylotsas <br />possibleintothelimiteddevelopmentarea,whereatleast30%oftheacreageistoosteepand <br />unstableforconstruction.RegardlessofwhetherApplicanthaspurchasedlandthatcannotbe <br />developed,thesitedesignshouldnotbecompromised,asforoneexample,byproposingnarrow <br />roadwayaccesseasementstoservethreetightlyclusteredlocations:lots5,6,8,9,lots16-17, <br />andlots18-19.Thisisdetrimentaltoeasyaccess,parking,andcirculationofvehicles,bicycles, <br />andpedestriansthroughthesite. <br />139 <br /> <br />
