Ratherthandirectlyaddressthisissueinthenarrativeofthe8/27/17writtenApplication,the <br />Applicant’sConsultanthas“tuckedaway”theirresponseinthebasicallyillegibleNotessection <br />ofthe1/19/18SheetL3.0.Item13oftheNotessectionindicates: <br />“TreesremovedinTractAasaresultofinstallationofstormsewersystemswillbereplaced <br />thefallimmediatelyfollowingacceptanceofthesystem.Replacementtreestobeanative <br />species,withaminimumcaliperof1½inchesforadeciduoustreesandaminimumheightof <br />5feetforconiferoustrees.” <br />Seeadditionalcommentsinthesectionbelowdiscussinginadequatereplacementtrees(Section <br />10(k). <br />Moreover,althoughtheApplicationstatesthatthispieceoflandwillbeaprivateutility <br />easement,anypublicutilityeasementislimitedby EC9.6500Easements(3)whichstates“No <br />building,structure,tree,orotherobstructionshallbeplacedorlocatedonorinapublicutility <br />easement.(Emphasisadded.)“PriortoapprovalofafinalPUD,finalsitereviewplans,orfinal <br />plats,thereshallappearthereonarestrictionshowingcompliancewiththissubsection.” <br />Applicantindicates:“Acknowledgedandagreed.” <br />Therefore,itappearsatthattheApplicant’sConsultantis“acknowledgingandagreeing”tothe <br />provisionimmediatelyprecedingtheirlanguageonPage51of67affirmingtheircompliance. <br />However,whatisomittedfromthisdiscussionisthatthiseasementisnotpublic;itisprivate. <br />Therefore,thelanguagetheyhavejustagreedtodoesn’tpertainandtheiragreementmeans <br />nothing. <br />ThisCityrequirementexistssothataccessformaintenanceoftheundergroundutilityequipment <br />isrelativelyeasyandsafe,especiallyifatimelyresponseiscritical.Oncetheareaisclearedand <br />thenewundergroundstormwaterequipmentisinstalled,werethisa“public”easement,nonew <br />landscapingwouldbeallowedtoreplaceloggedtreesorclearedvegetation. <br />Whyshouldmaintenanceaccesstoa“private”stormwatereasementbeheldtoalower <br />standard? <br />Therefore,theApplicationismisleadingandinaccurateintreatingutilityeasementsand <br />preservationareas.THEAPPLICATIONSHOULDBEDENIED. <br />#### <br />EC9.6505(3)(b):Allpavingshallprovidefordrainageofallsuchstreetsandalleys, <br />andconstructcurbsandgutters,sidewalks,streettreesandstreetlightsadjacentto <br />thedevelopmentsiteaccordingtotheDesignStandardsandGuidelinesforEugene <br />Streets,BikewaysandAccessways... <br />TheApplicationproposesa"flushcurbwitha1–2footgravelshoulderfromStation3+31.40to <br />7+96.80."SaidflushcurbisshownonSheetC3oftheSitePlans:PublicRoadwayPlanand <br />108 <br /> <br />
