The definition of street tree is as follows: <br />Street Tree. A living, standing tree with a trunk diameter or, for <br />trees with multiple trunks, a cumulative trunk diameter, or at least <br />1-112 inches at a point 6 inches above mean ground level at the <br />base of the trunk, and that is located within the public street right- <br />of-way, or shown on an approved street tree plan. <br />As the trees existing in the right-of-way, as listed above and identified on sheet C110 of the applicant's <br />site plans, meet the definition of a street tree, sheet C110 provides evidence that street trees exist. <br />However, sheet C110 is titled as a "Tree Preservation Plan Sheet" and it is not clear that sheet C110 is <br />intended to satisfy EC 7.280. <br />As the applicant has not provided a street tree plan, or provided documentation that it has requested <br />approval of a plan, it is necessary to condition the approval. The following condition of approval is <br />provided to ensure the applicant obtains a street tree plan: <br />Condition: As required by EC 7.280(3), building permits for the hotel shall not be <br />issued until the City approves a street tree plan consistent with EC 7.280 and the <br />City's Street Tree Program Administrative Rule (R-7.280) adopted by <br />Administrative Order No. 58-15-02-F. <br />Conclusion: Based on the findings above, the Planning Commission concludes that EC 7.280 and <br />subsequently EC 9.2170(5) can be met as conditioned. <br />III. CONCLUSION <br />Accordingly, the section of the Planning Commission's final order dated September 19th, 2016, entitled <br />Appeal Issue #1: Street Tree Requirements, is hereby amended as shown above. <br />The foregoing findings and conclusion are adopted as the Final Order of the Eugene Planning <br />Commission, for Towneplace Suites (WG 16-1; SR 16-1; ARB 16-3), this 26th day of February, 2018. <br />JoMn ofsky, Chair <br />Euge a Planning Commission <br />4 <br />
